2007 A Bill for An Act to amend the Land Court Act 2000 and other Acts administered by the Attorney-General and Minister for Justice and Minister assisting the Premier in Western Queensland, and for related purposes
s1 6 s5 Land Court and Other Legislation Amendment Bill 2007 The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Land Court and Other 4 Legislation Amendment Act 2007. 5 Clause 2 Commencement 6 This Act, other than the following provisions, commences on 7 a day to be fixed by proclamation-- 8 � section 16, to the extent it inserts sections 89, 90 and 91 9 � section 27, to the extent it inserts sections 86, 87, 88 and 10 89. 11 Part 2 Amendment of Land and 12 Resources Tribunal Act 1999 13 Clause 3 Act amended in pt 2 14 This part amends the Land and Resources Tribunal Act 1999. 15 Clause 4 Omission of ss 10-12 16 Sections 10 to 12-- 17 omit. 18 Clause 5 Insertion of new s 14A 19 Part 2, division 2-- 20
s6 7 s6 Land Court and Other Legislation Amendment Bill 2007 insert-- 1 `14A Land Court member filling vacancy of presiding 2 member 3 `(1) This section applies if a person who is a member of the Land 4 Court is appointed to act as a presiding member for a period. 5 `(2) For the period, the person is not a Land Court non-presiding 6 member under section 15(2). 7 `(3) However-- 8 (a) the person's appointment as a member of the Land 9 Court is otherwise unaffected; and 10 (b) in particular, the person may continue to perform duties 11 as a member of the Land Court as well as performing 12 duties as an acting presiding member. 13 `(4) The person is not entitled to any salary or allowances in 14 addition to the person's salary and allowances as a member of 15 the Land Court unless the instrument of appointment under 16 section 14 otherwise provides. 17 Note-- 18 See also sections 87 and 92(2).'. 19 Clause 6 Insertion of new s 19A 20 After section 19-- 21 insert-- 22 `19A Land Court officer filling vacancy of referee 23 non-presiding member 24 `(1) This section applies if a referee non-presiding member is 25 required for the purposes of a proceeding in the tribunal and 26 there is no person holding office as a referee non-presiding 27 member of the type required for the proceeding. 28 `(2) To remove any doubt, it is declared that-- 29 (a) the Governor in Council may act under section 19 to 30 appoint a person to act as a referee non-presiding 31 member only for the proceeding; and 32 (b) the person appointed may be-- 33
s7 8 s9 Land Court and Other Legislation Amendment Bill 2007 (i) a judicial registrar of the Land Court, appointed 1 and employed under the Land Court Act 2000, 2 section 28, who is eligible for appointment; or 3 (ii) the registrar, a deputy registrar or another officer of 4 the Land Court, appointed under the Land Court 5 Act 2000, section 48(2) and (3), who is eligible for 6 appointment. 7 `(3) Subsection (2)(b) does not limit subsection (2)(a). 8 `(4) If the person appointed is a judicial registrar or officer 9 mentioned in subsection (2)(b), the person is not entitled to 10 any salary or allowances in addition to the person's salary and 11 allowances as a judicial registrar or officer of the Land Court 12 unless the instrument of appointment otherwise provides. 13 Note-- 14 See also section 87.'. 15 Clause 7 Amendment of s 29 (Registrar of tribunal) 16 (1) Section 29(3), `Subject to the president, the'-- 17 omit, insert-- 18 `The'. 19 (2) Section 29(5)-- 20 omit. 21 Clause 8 Omission of s 38 (Arrangement of business) 22 Section 38-- 23 omit. 24 Clause 9 Amendment of s 39 (General requirements for 25 constituting tribunal for proceeding) 26 (1) Section 39(3)(c)-- 27 omit. 28

s 15 10 s 16 Land Court and Other Legislation Amendment Bill 2007 Clause 15 Insertion of new s 82A 1 Part 5-- 2 insert-- 3 `82A Expiry of Act 4 `This Act expires on 31 December 2011.'. 5 Clause 16 Replacement of pt 6 6 Part 6-- 7 omit, insert-- 8 `Part 6 Transitional provisions for 9 Land Court and Other 10 Legislation Amendment Act 11 2007 12 `87 Use of acting appointment provisions having regard 13 to limited jurisdiction of tribunal 14 `(1) Generally, the purpose of the Land Court and Other 15 Legislation Amendment Act 2007 is to transfer the tribunal's 16 jurisdiction to the Land Court. 17 Note-- 18 See the Land Court Act 2000, section 91 for arrangements for 19 proceedings now falling within the jurisdiction of the Land Court that 20 are part heard. 21 `(2) The tribunal's ongoing jurisdiction, until the expiry of this Act 22 takes effect under section 82A, is limited to proceedings about 23 applications under the Mineral Resources Act 1989-- 24 (a) lodged under that Act on or before 31 March 2003 and 25 to which the native title (mining) provisions apply; and 26 (b) whether or not, for any application, a proceeding about 27 the application was started before the tribunal before the 28 commencement of this section. 29 `(3) The Governor in Council-- 30 (a) is not obliged-- 31
s 16 11 s 16 Land Court and Other Legislation Amendment Bill 2007 (i) to act under section 7 to appoint 1 or more 1 presiding members of the tribunal; or 2 (ii) to act under section 16 to appoint 1 or more 3 non-presiding members; and 4 (b) for the purposes of the tribunal's ongoing jurisdiction, 5 may act as may be convenient-- 6 (i) under section 14, to appoint persons to act as 7 presiding members; and 8 (ii) under section 19, to appoint persons to act as 9 appointed non-presiding members. 10 `(4) Also, the Acts Interpretation Act 1954, section 24B(5) does 11 not apply to an appointment mentioned in subsection (3). 12 `(5) A person may be both-- 13 (a) the registrar or another member of the staff of the 14 tribunal, as mentioned in section 29; and 15 (b) the registrar of the Land Court, or a deputy registrar or 16 other officer of the Land Court, as mentioned in the 17 Land Court Act 2000, section 48. 18 `(6) Subsections (3) and (4) are to remove any doubt. 19 `88 Annual report 20 `(1) If, before the commencement of this section, the president had 21 not given the Minister a report on the operations of the 22 tribunal for the financial year ending 30 June 2007-- 23 (a) the president of the Land Court must, within 4 months 24 after the commencement of this section, prepare and 25 give to the Minister the report; and 26 (b) the Minister must cause a copy of the report to be tabled 27 in the Legislative Assembly within 14 days after its 28 receipt by the Minister. 29 `(2) If, before the commencement of this section, the president had 30 given the Minister a report on the operations of the tribunal for 31 the financial year ending 30 June 2007, but the Minister had 32 not caused a copy of the report to be tabled in the Legislative 33
s 16 12 s 16 Land Court and Other Legislation Amendment Bill 2007 Assembly, the Minister must cause a copy of the report to be 1 tabled in the Legislative Assembly within 14 days after the 2 commencement of this section. 3 `89 Arrangements for president 4 `(1) This section applies to the person holding appointment under 5 section 7 as president on the commencement of this section. 6 `(2) The Minister must make the following offer to the person-- 7 (a) that if the person resigns from office, the Minister will 8 recommend to the Governor in Council that the person 9 be appointed as a District Court judge; 10 (b) that if the person is appointed as a District Court judge, 11 the person will receive the entitlements mentioned in the 12 Land Court Act 2000, section 86. 13 `(3) If the person accepts the offer within 30 days, the Minister 14 must recommend to the Governor in Council that the person 15 be appointed as a District Court judge. 16 `90 Arrangements for deputy president 17 `(1) This section applies to a person holding appointment under 18 section 7 as deputy president on the commencement of this 19 section. 20 `(2) The Minister must make the following offer to the person-- 21 (a) that if the person resigns from office as deputy 22 president, the Minister will recommend to the Governor 23 in Council that the person be appointed as a member of 24 the Land Court; 25 (b) that if the person is appointed as a member of the Land 26 Court, the person will receive the entitlements 27 mentioned in the Land Court Act 2000, section 87. 28 `(3) If the person accepts the offer within 30 days, the Minister 29 must recommend to the Governor in Council that the person 30 be appointed as a member of the Land Court. 31
s 16 13 s 16 Land Court and Other Legislation Amendment Bill 2007 `91 Arrangements for mining referee 1 `(1) This section applies to a person holding appointment under 2 section 16(2) as a mining referee on the commencement of 3 this section. 4 `(2) The Minister must make the following offer to the person-- 5 (a) that if the person resigns from office as mining referee, 6 the Minister will recommend to the Governor in Council 7 that the person be appointed as a judicial registrar of the 8 Land Court until 16 July 2008; 9 (b) that if the person is appointed as a judicial registrar of 10 the Land Court, the person will receive the entitlements 11 mentioned in the Land Court Act 2000, section 88. 12 `(3) If the person accepts the offer within 30 days, the Minister 13 must recommend to the Governor in Council that the person 14 be appointed as a judicial registrar of the Land Court. 15 `92 Effect of repeal of ss 10-12 16 `(1) On the repeal of sections 10 to 12, a person still holding 17 appointment under section 7 as president or deputy 18 president-- 19 (a) ceases to be entitled to any salary or allowance, or to any 20 other employment or appointment related benefit, under 21 the operation of the repealed sections; and 22 (b) is not entitled to any salary or allowance, or to any other 23 employment or appointment related benefit, to which 24 the person might otherwise be entitled because of the 25 continued holding of the appointment. 26 Note-- 27 See the Land Court Act 2000, sections 86 and 87 for the accrued rights 28 of the president and deputy president. 29 `(2) For the purposes of the ongoing work of the tribunal-- 30 (a) the person's office of president or deputy president is 31 taken to have been vacated; and 32 (b) an acting appointment to the office may be made as 33 provided under section 87(3)(b)(i).'. 34

s 21 15 s 21 Land Court and Other Legislation Amendment Bill 2007 `(4) The jurisdiction of the Land Court can not be ousted only 1 because a proceeding before it is about claims or interests of 2 an equitable nature or involves making a decision about title 3 to land.'. 4 Clause 21 Insertion of new pt 2, div 1A 5 After section 6-- 6 insert-- 7 `Division 1A Cultural heritage division 8 `6A Divisions of court 9 `(1) The Land Court is divided into 2 divisions as follows-- 10 (a) the Cultural Heritage and Indigenous Land Use 11 Agreement Division; 12 (b) the general division. 13 `(2) A member may sit as, and exercise the powers and perform 14 the functions of, a member of the Land Court in the cultural 15 heritage division or the general division, as nominated by the 16 president. 17 `(3) A member may be nominated for both the cultural heritage 18 division and the general division. 19 `6B Purpose of cultural heritage division 20 `The cultural heritage division is to exercise the jurisdiction of 21 the Land Court in all matters coming before the court under 22 any of the following-- 23 (a) Aboriginal Cultural Heritage Act 2003; 24 (b) Torres Strait Islander Cultural Heritage Act 2003; 25 (c) division 6B.'. 26
s 22 16 s 23 Land Court and Other Legislation Amendment Bill 2007 Clause 22 Amendment of s 16 (Appointment of president and other 1 members of Land Court) 2 Section 16(4)(a)-- 3 omit, insert-- 4 `(a) a local lawyer within the meaning of the Legal 5 Profession Act 2007 of at least 5 years' standing with 6 extensive experience in 1 or more of the following-- 7 (i) land-related matters; 8 (ii) mining or petroleum issues; 9 (iii) indigenous issues; 10 (iv) something else considered by the Governor in 11 Council to have substantial relevance to the duties 12 of a member; or'. 13 Clause 23 Insertion of new pt 2, divs 6A to 6C 14 After section 32-- 15 insert-- 16 `Division 6A Indigenous assessors 17 `32A Indigenous assessors 18 `(1) The Governor in Council may appoint indigenous assessors to 19 perform functions in the Land Court in its cultural heritage 20 division for proceedings to which they are allocated. 21 `(2) A person is eligible to be appointed as an indigenous assessor 22 only if-- 23 (a) the person-- 24 (i) has experience, for not less than 5 years, in 25 industry, commerce, public administration, the 26 practice of a profession or the service of a 27 government or an authority of a government; or 28 (ii) has researched, and published in journals of high 29 academic quality, in the field of anthropology, 30
s 23 17 s 23 Land Court and Other Legislation Amendment Bill 2007 history, law, public administration or indigenous 1 issues; and 2 (b) the person has, in the opinion of the Governor in 3 Council, a high level of knowledge of or experience in 2 4 or more of the following-- 5 (i) cross-cultural issues; 6 (ii) resolving cultural heritage issues; 7 (iii) indigenous issues; 8 (iv) something else considered by the Governor in 9 Council to have substantial relevance to the duties 10 of an indigenous assessor. 11 `(3) A member is not eligible for appointment as an indigenous 12 assessor. 13 `(4) An indigenous assessor who is allocated to a proceeding of 14 the Land Court in its cultural heritage division is an officer of 15 the Land Court for the proceeding. 16 `32B Conditions of appointment of indigenous assessor 17 `(1) The remuneration and allowances payable to an indigenous 18 assessor are the remuneration and allowances decided by the 19 Governor in Council. 20 `(2) An indigenous assessor holds office as an indigenous assessor 21 on the conditions, including the indigenous assessor's term of 22 appointment, decided by the Governor in Council. 23 `(3) An indigenous assessor is appointed under this Act and not 24 under the Public Service Act 1996. 25 `(4) An indigenous assessor may resign by giving a signed notice 26 of resignation to the Minister. 27 `32C Allocation of indigenous assessor for a proceeding in 28 the cultural heritage division 29 `(1) The president may allocate an indigenous assessor to a 30 proceeding of the Land Court in its cultural heritage division 31
s 23 18 s 23 Land Court and Other Legislation Amendment Bill 2007 if the president is satisfied the allocation will help to achieve 1 the prompt and efficient conduct of the proceeding. 2 `(2) The president is not required to allocate an indigenous 3 assessor to a proceeding in the cultural heritage division. 4 `32D Role of indigenous assessor for a proceeding 5 `(1) The role of an indigenous assessor for a proceeding in the 6 Land Court in its cultural heritage division is to advise the 7 court about matters within the indigenous assessor's 8 knowledge or experience that are relevant to a question arising 9 in the proceeding. 10 `(2) The indigenous assessor does not form part of the Land Court 11 for the proceeding. 12 `(3) It is not necessary for the indigenous assessor to be present for 13 all of the proceeding. 14 `(4) All advice given under subsection (1) must be disclosed to the 15 parties to the proceeding, and the parties must be given an 16 opportunity to make submissions on the content of the advice. 17 `Division 6B Jurisdiction of Land Court in its 18 cultural heritage division 19 `32E Jurisdiction under Commonwealth Native Title Act 20 `(1) This section applies if, under the Commonwealth Native Title 21 Act-- 22 (a) a claimant or body corporate objects to the doing of an 23 act; and 24 (b) the State is required to ensure that the objection to the 25 doing of the act is heard by an independent person or 26 body. 27 `(2) The Land Court in its cultural heritage division has 28 jurisdiction to hear the objection. 29
s 23 19 s 23 Land Court and Other Legislation Amendment Bill 2007 `32F Jurisdiction for registered indigenous land use 1 agreements 2 `(1) This section applies if-- 3 (a) there is a registered indigenous land use agreement 4 under the Commonwealth Native Title Act; and 5 (b) the State is a party to the agreement; and 6 (c) the agreement provides for a matter arising under the 7 agreement to be referred to the LRT or the Land Court 8 for-- 9 (i) mediation of the matter; or 10 (ii) the making of a recommendation about the matter; 11 or 12 (iii) the making of a decision about the matter. 13 `(2) The Land Court in its cultural heritage division has 14 jurisdiction-- 15 (a) if subsection (1)(c)(i) applies--to mediate the matter 16 under division 8; or 17 (b) if subsection (1)(c)(ii) applies--to make a 18 recommendation about the matter; or 19 (c) if subsection (1)(c)(iii) applies--to make a decision 20 about the matter. 21 `32G Jurisdiction for negotiated agreements 22 `(1) A party to a negotiated agreement may apply to the Land 23 Court for an order-- 24 (a) for the enforcement of a negotiated agreement; or 25 (b) deciding a matter arising under a negotiated agreement; 26 or 27 (c) making a declaration about the interpretation of a 28 negotiated agreement. 29 `(2) The Land Court in its cultural heritage division must hear and 30 decide an application under subsection (1) and may make the 31 order it considers appropriate. 32
s 23 20 s 23 Land Court and Other Legislation Amendment Bill 2007 `(3) For subsection (5), definition negotiated agreement, a 1 reference to a part or division of the Mineral Resources Act 2 includes a reference to the part or division as applied by 3 another provision, or other provisions, of the native title 4 (mining) provisions. 5 `(4) Without limiting subsections (1) to (3), a reference in a 6 negotiated agreement to the LRT must, if the context permits, 7 be taken to be a reference to the Land Court in its cultural 8 heritage division. 9 `(5) In this section-- 10 native title (mining) provisions means the Mineral Resources 11 Act, parts 12 to 18 and part 19, divisions 2 and 5. 12 negotiated agreement means-- 13 (a) an access agreement under the Mineral Resources Act, 14 part 13, part 15, division 2 or part 16, division 2; or 15 (b) a negotiated agreement under the Mineral Resources 16 Act, part 17, division 4; or 17 (c) an agreement about the payment of compensation 18 mentioned in the Mineral Resources Act, part 18; or 19 (d) an agreement obtained under the Commonwealth Native 20 Title Act, section 31(1)(b). 21 `32H Jurisdiction for particular cultural heritage matters 22 `(1) A group, or a member of a group, may apply to the Land 23 Court for an injunction under this section to stop the doing of 24 an act. 25 `(2) The Land Court in its cultural heritage division must hear and 26 decide an application under subsection (1) and may grant the 27 injunction only if the court is satisfied that-- 28 (a) the person against whom the injunction is sought is 29 doing the act, or there are reasonable grounds for 30 concluding that the person is likely to do the act; and 31 (b) the act is a relevant act; and 32 (c) the applicant has standing to make the application; and 33
s 23 21 s 23 Land Court and Other Legislation Amendment Bill 2007 (d) it is necessary to grant the injunction to stop the person 1 doing the act. 2 `(3) For this section, a group or member of a group has standing to 3 make an application if the group has a traditional, historic or 4 custodial interest in-- 5 (a) if the relevant act is a contravention of an Aboriginal 6 cultural heritage protection provision--the Aboriginal 7 cultural heritage to which the contravention relates; or 8 (b) if the relevant act is a contravention of a Torres Strait 9 Islander cultural heritage protection provision--the 10 Torres Strait Islander cultural heritage to which the 11 contravention relates; or 12 (c) if neither paragraph (a) nor paragraph (b) applies--an 13 item, place or area of cultural significance that may be 14 adversely affected by the doing of the act the subject of 15 the application. 16 `(4) In this section-- 17 Aboriginal cultural heritage protection provision means the 18 Aboriginal Cultural Heritage Act 2003, section 24(1), 25(1) 19 or 26(1). 20 group means a group of Aboriginal people or Torres Strait 21 Islanders. 22 relevant act means an act that is a contravention of-- 23 (a) an Aboriginal cultural heritage protection provision; or 24 (b) a Torres Strait Islander cultural heritage protection 25 provision; or 26 (c) a provision of another Act providing for the protection 27 or preservation or access to, items, places or areas of 28 cultural significance to Aboriginal people or Torres 29 Strait Islanders. 30 Torres Strait Islander cultural heritage protection provision 31 means the Torres Strait Islander Cultural Heritage Act 2003, 32 section 24(1), 25(1) or 26(1). 33
s 23 22 s 23 Land Court and Other Legislation Amendment Bill 2007 `32I Jurisdiction for contract conditions 1 `(1) A relevant person may apply to the Land Court for an order-- 2 (a) for the enforcement of contract conditions; or 3 (b) to decide a matter under contract conditions; or 4 (c) making a declaration about the interpretation of contract 5 conditions. 6 `(2) The Land Court must hear and decide an application under 7 subsection (1) and may make the order it considers 8 appropriate. 9 `(3) Without limiting subsections (1) and (2), a reference in 10 contract conditions to the LRT must, if the context permits, be 11 taken to be a reference to the Land Court in its cultural 12 heritage division. 13 `(4) In this section-- 14 contract conditions means contract conditions under the 15 relevant provision, as applying in relation to-- 16 (a) a mining lease; or 17 (b) another mining tenement, because of the application of 18 the Mineral Resources Act, part 17, division 4 to the 19 mining tenement. 20 mining tenement means a prospecting permit, mining claim, 21 exploration permit, mineral development licence or mining 22 lease under Mineral Resources Act. 23 relevant person means a consultation and negotiation party 24 under the relevant provision. 25 relevant provision means the Mineral Resources Act, section 26 675(1)(b)(ii). 27
s 23 23 s 23 Land Court and Other Legislation Amendment Bill 2007 `Division 6C Additional power of Land Court 1 when exercising particular 2 jurisdiction 3 `32J Land Court has power of the Supreme Court for 4 particular purposes 5 `(1) This section applies when-- 6 (a) the Land Court in its cultural heritage division is 7 exercising jurisdiction; or 8 (b) the Land Court in its general division is exercising 9 jurisdiction under any of the following Acts that was 10 conferred on the Land Court under the Land Court and 11 Other Legislation Amendment Act 2007-- 12 � Environmental Protection Act 1994 13 � Fossicking Act 1994 14 � Geothermal Exploration Act 2004 15 � Mineral Resources Act 1989 16 � Petroleum Act 1923 17 � Petroleum and Gas (Production and Safety) Act 18 2004 19 � State Development and Public Works Organisation 20 Act 1971 21 � Water Act 2000. 22 `(2) The Land Court has, for exercising jurisdiction conferred 23 under an Act, all the powers of the Supreme Court, and may in 24 a proceeding before the Land Court, in the same way and to 25 the same extent as may be done by the Supreme Court in a 26 similar proceeding-- 27 (a) grant any relief or remedy; and 28 (b) make any order, including an order for attachment or 29 committal because of disobedience to an order; and 30 (c) give effect to every ground of defence or matter of 31 set-off, whether equitable or legal. 32
s 23 24 s 23 Land Court and Other Legislation Amendment Bill 2007 `(3) Without limiting subsection (2), the Land Court has, in a 1 proceeding before it, power to grant relief-- 2 (a) under a declaration of rights of the parties; or 3 (b) under an injunction, whether interim, interlocutory or 4 final, in the proceeding; or 5 (c) by staying the proceeding or a part of the proceeding; or 6 (d) by appointing a receiver including an interim receiver. 7 `(4) The Land Court may order that a record of, or information 8 about, a proceeding before the Land Court must not be made 9 available to the public. 10 `(5) Without limiting the things the Land Court may have regard 11 to in deciding whether to make an order under subsection (4), 12 the Land Court may have regard to Aboriginal tradition and 13 Island custom. 14 `(6) To the extent that the practice and procedure of the Land 15 Court in exercising its jurisdiction in particular matters, 16 including enforcing its judgments and orders, are not provided 17 for in the rules, they must as far as practicable be the same as 18 the practice and procedure of the Supreme Court in similar 19 matters. 20 `(7) Without limiting subsection (6), the appropriate officer of the 21 Land Court must, in addition to duties otherwise imposed on 22 the officer, discharge-- 23 (a) any duty an officer of the Supreme Court would be 24 required under the practice of the Supreme Court to 25 discharge in similar circumstances; and 26 (b) any duty imposed on the officer by an order of the Land 27 Court. 28 `(8) For subsection (7), the appropriate officer of the Land Court 29 has the powers of the relevant officer of the Supreme Court. 30 `(9) Subsections (2) and (6) have effect subject to-- 31 (a) another provision of this Act; and 32 (b) a provision of another Act under which jurisdiction is 33 conferred on the Land Court.'. 34

s 27 26 s 27 Land Court and Other Legislation Amendment Bill 2007 insert-- 1 `Division 2 Transitional provisions for Land 2 Court and Other Legislation 3 Amendment Act 2007 4 `86 LRT president 5 `(1) This section applies if the person (the relevant person) 6 holding appointment under the LRT Act, section 7 as the 7 president of the LRT-- 8 (a) resigns the person's office as president (the 9 resignation); and 10 (b) at or about the same time as the resignation takes effect, 11 is appointed as a District Court judge (the new 12 appointment). 13 `(2) From the new appointment, and while the relevant person 14 holds the appointment, the salary, allowances and rates of 15 allowances payable to the relevant person cease to be those 16 payable to a Supreme Court judge and become those payable 17 to a District Court judge. 18 `(3) On being appointed, the relevant person is entitled to receive a 19 single payment of an amount equal to the difference between 20 the salary, allowances and rates of allowances payable to a 21 Supreme Court judge and those payable to a District Court 22 judge for the period starting on the day of appointment and 23 ending on the prescribed day. 24 `(4) The State has no liability of any kind, other than as provided 25 for in subsection (3), to compensate the relevant person in any 26 way because of the resignation and new appointment, and in 27 particular because of any reduced salary, allowances and rates 28 of allowances payable to the person after the prescribed day. 29 `(5) Subject to subsection (6), the relevant person retains all 30 entitlements accrued but not received by the person while the 31 person was the president of the LRT. 32 `(6) Leave, including leave of absence under the Judges Pensions 33 Act, accrued by the person and not taken before the date of 34
s 27 27 s 27 Land Court and Other Legislation Amendment Bill 2007 appointment is to be paid at the salary applicable to a District 1 Court judge. 2 `(7) Subsection (8) applies if, after the new appointment, the 3 relevant person continues uninterruptedly as a District Court 4 judge until the person-- 5 (a) retires after the prescribed day; or 6 (b) retires or is removed from office as mentioned in the 7 Judges Pensions Act, section 5(1); or 8 (c) earlier dies. 9 `(8) The Judges Pensions Act, to the extent that Act provides for 10 the payment of any pension, including for example the 11 payment of a pension to a spouse or child, is taken to apply in 12 relation to the relevant person as if the person-- 13 (a) had been a Supreme Court judge from when the person 14 was appointed president of the LRT until the person's 15 retirement or death as mentioned in subsection (7) (the 16 relevant period); and 17 (b) had been entitled to the salary, as defined under that Act, 18 of a Supreme Court judge as applying from time to time 19 in the relevant period. 20 `(9) In this section-- 21 prescribed day, in relation to the relevant person, means the 22 first day on which the relevant person would become eligible 23 to receive a pension under the Judges Pensions Act, section 4, 24 if the relevant person retired from office (otherwise than 25 because of permanent disability or infirmity as specified in 26 section 5 of that Act) on that day. 27 `87 LRT deputy president 28 `(1) This section applies if a person (the relevant person) holding 29 appointment under the LRT Act, section 7 as a deputy 30 president of the LRT-- 31 (a) resigns the person's office as deputy president (the 32 resignation); and 33
s 27 28 s 27 Land Court and Other Legislation Amendment Bill 2007 (b) at or about the same time as the resignation takes effect, 1 is appointed as a member of the Land Court (the new 2 appointment). 3 `(2) From the new appointment, and while the relevant person 4 holds the appointment, the salary, allowances and rates of 5 allowances payable to the relevant person cease to be those 6 payable to a District Court judge and become those payable to 7 a member of the Land Court. 8 `(3) The State has no liability of any kind to compensate the 9 relevant person in any way because of the resignation and new 10 appointment, and in particular because of any reduced salary, 11 allowances and rates of allowances payable to the person after 12 the new appointment. 13 `(4) The relevant person retains all entitlements accrued but not 14 received by the person while the person was a deputy 15 president of the LRT, and for calculating any amount payable 16 to the person in relation to an entitlement accrued but not 17 received, the applicable salary and allowances of the person 18 are taken to be the salary and allowances of a District Court 19 judge in force when the amount comes to be calculated. 20 `(5) Subsection (6) applies if, after the new appointment, the 21 relevant person continues uninterruptedly as a member of the 22 Land Court until the person-- 23 (a) retires after the prescribed day; or 24 (b) retires or is removed from office as mentioned in the 25 Judges Pensions Act, section 5(1); or 26 (c) earlier dies. 27 `(6) The Judges Pensions Act, to the extent that Act provides for 28 the payment of any pension, including for example the 29 payment of a pension to a spouse or child, is taken to apply in 30 relation to the relevant person as if the person-- 31 (a) had been a District Court judge from when the person 32 was appointed a deputy president of the LRT until the 33 person's retirement or death as mentioned in subsection 34 (5) (the relevant period); and 35
s 27 29 s 27 Land Court and Other Legislation Amendment Bill 2007 (b) had been entitled to the salary, as defined under that Act, 1 of a District Court judge as applying from time to time 2 in the relevant period. 3 `(7) In this section-- 4 prescribed day, in relation to the relevant person, means the 5 first day on which the relevant person would become eligible 6 to receive a pension under the Judges Pensions Act, section 4, 7 if the relevant person retired from office (otherwise than 8 because of permanent disability or infirmity as specified in 9 section 5 of that Act) on that day. 10 `88 LRT mining referee 11 `(1) This section applies if a person (the relevant person), holding 12 appointment under the LRT Act, section 16(2)(c) as a mining 13 referee of the LRT-- 14 (a) resigns the person's office as mining referee (the 15 resignation); and 16 (b) at or about the same time as the resignation takes effect, 17 is appointed as a judicial registrar of the Land Court (the 18 new appointment) under this Act. 19 `(2) From the new appointment until 16 July 2008, and while the 20 relevant person holds the appointment, the salary and 21 allowances payable, and the conditions applicable, to the 22 relevant person continue to be those payable and applicable to 23 the person under the person's instrument of appointment as a 24 mining referee of the LRT. 25 `(3) The State has no liability of any kind to compensate the 26 relevant person in any way because of the person's ceasing to 27 hold appointment as a referee non-presiding member under 28 the LRT Act and being appointed under this Act as a judicial 29 registrar. 30 `(4) The relevant person retains all entitlements accrued but not 31 received by the person while the person was a mining referee 32 of the LRT, and for calculating any amount payable to the 33 person in relation to an entitlement accrued but not received, 34 the applicable salary and allowances of the person continue to 35 be the salary and allowances payable to the person under the 36
s 27 30 s 27 Land Court and Other Legislation Amendment Bill 2007 person's instrument of appointment as a mining referee of the 1 LRT when the amount comes to be calculated. 2 `(5) The relevant person's entitlements under this section must not 3 be reduced. 4 `(6) Sections 45 and 46 do not apply to the relevant person. 5 `(7) The relevant person may resign the person's appointment as a 6 judicial registrar by giving a signed notice of resignation to 7 the Minister. 8 `(8) The appointment and employment of the relevant person as a 9 judicial registrar is not subject to any industrial award, 10 industrial agreement or other industrial instrument or any 11 decision or rule of an industrial tribunal. 12 `(9) At the end of the relevant person's term as a judicial registrar, 13 the relevant person ceases to hold office and the relevant 14 person has no further entitlement to hold office under this Act 15 or the LRT Act. 16 `89 Previous LRT deputy president 17 `(1) This section applies to a person if-- 18 (a) before the commencement of this section-- 19 (i) the person held appointment under the LRT Act, 20 section 7 as a deputy president of the LRT; and 21 (ii) the person resigned the person's office as a deputy 22 president (the resignation); and 23 (iii) at or about the same time as the resignation took 24 effect, the person was appointed as a District Court 25 judge (the new appointment); and 26 (b) on the commencement of this section, the person still 27 held the new appointment. 28 `(2) For the purposes of the application of the Judges Pensions Act 29 to the person, that Act is taken to apply to the person, 30 including to a spouse or child of the person, as if the person 31 had been a District Court judge for the whole of the time from 32 when the person was appointed a deputy president of the LRT 33 until the new appointment. 34
s 27 31 s 27 Land Court and Other Legislation Amendment Bill 2007 `90 Assumption by Land Court of role of warden and 1 Wardens Court under particular Acts 2 `(1) The relevant mining Act provisions are taken to continue to 3 have effect as if the Land and Resources Tribunal Act 1999 4 had not been enacted, but only to the extent necessary for 5 giving full effect to the relevant designated Act provisions. 6 `(2) A reference in a relevant mining Act provision or relevant 7 designated Act provision to a warden or the Wardens Court is 8 taken to be a reference to the Land Court. 9 `(3) In subsection (4), definition designated Acts, a reference to an 10 Act includes a reference to any instrument-- 11 (a) that has been made or entered into under the Act; and 12 (b) that the reference to the Act does not otherwise include. 13 `(4) In this section-- 14 designated Acts means the following Acts-- 15 � Alcan Queensland Pty. Limited Agreement Act 1965 16 � Central Queensland Coal Associates Agreement Act 17 1968 18 � Offshore Minerals Act 1998 19 � Petroleum Act 1923 20 � Queensland Nickel Agreement Act 1970 21 � Thiess Peabody Coal Pty. Ltd. Agreement Act 1962. 22 relevant designated Act provisions means the provisions of 23 the designated Acts that mention a warden or the Wardens 24 Court. 25 relevant mining Act provisions means the provisions of the 26 Mineral Resources Act 1989 that, immediately before the 27 commencement of the LRT Act, section 86 mentioned, 28 directly or indirectly, a warden or the Wardens Court. 29 `91 Land Court to assume jurisdiction for proceedings 30 already before the LRT 31 `(1) This section applies to a proceeding if-- 32
