1993 A BILL FOR An Act to amend the City of Brisbane Act 1924 and the Local Government Act 1936
4 Local Government Legislation Amendment BE IT ENACTED by the Queen's Most Excellent Majesty, by and with 1 the advice and consent of the Legislative Assembly of Queensland in 2 Parliament assembled, and by the authority of the same, as follows. 3 PART 1--PRELIMINARY 4 title 5 Short This Act may be cited as the Local Government Legislation 6 Clause1. Amendment Act 1993. 7 ART 2--AMENDMENT OF CITY OF BRISBANE 8 P ACT 1924 9 Act 10 Amended The City of Brisbane Act 1924 is amended as set out in this Part. 11 Clause2. of s.4 (Area declared a City) 12 Replacement Section 4-- 13 Clause3. omit, insert-- 14 of Brisbane 15 `City `4.(1) The area of the City of Brisbane continues to be a city under the 16 name City of Brisbane. 17 `(2) The boundaries of the City are the boundaries of the City 18 immediately before the commencement of the Local Government 19 Legislation Amendment Act 1993, as subsequently varied under section 5 of 20 the Local Government Act.'. 21
5 Local Government Legislation Amendment of s.36A (Construction by the Council of bridges across 1 Replacement tidal rivers, etc.) 2 Section 36A-- 3 Clause4. omit, insert-- 4 5 `Bridges `36A.(1) This section applies to a bridge if it-- 6 (a) crosses a tidal river, creek or stream or other tidal water; and 7 (b) has 1 or both ends in the City. 8 `(2) The Council may construct bridges and their approaches. 9 `(3) The Council may assume responsibility from other persons for 10 bridges and their approaches. 11 `(4) The Council may renew, modify, extend or enlarge a bridge 12 ("Council bridge")-- 13 (a) that it controlled immediately before the commencement of this 14 section; or 15 (b) that it constructs under subsection (2); or 16 (c) for which it assumes responsibility under subsection (3). 17 `(5) In acting under subsections (2), (3) and (4), the Council must ensure 18 that the requirements of section 86 of the Harbours Act 1955 that apply to 19 the bridge are complied with. 20 `(6) Without limiting section 36, the Council may maintain, manage, 21 control and regulate the use of a Council bridge. 22 `(7) If only 1 end of a Council bridge is within the City, the Council must 23 ensure that the following restrictions, conditions and terms are complied 24 with in relation to the bridge-- 25 (a) restrictions, conditions and terms fixed by the Governor in 26 Council before the commencement of this section; 27 (b) restrictions and terms fixed by regulation after the 28 commencement. 29 `(8) Subject to any applicable restriction, condition or term mentioned in 30 subsection (7)-- 31
6 Local Government Legislation Amendment (a) ordinances apply to a Council bridge as if the whole of the bridge 1 were within the City; and 2 (b) the whole of the bridge is taken, for the purposes of any Act, to 3 be a road within the City. 4 `(9) Section 52(9)(i) of the Local Government Act applies to a Council 5 bridge.'. 6 of s.129 (Provision for enlargement of the City) 7 Omission Section 129-- 8 Clause5. omit. 9 of Schedule 1 (Boundaries of the City) 10 Omission Schedule 1-- 11 Clause6. omit. 12 PART 3--AMENDMENT OF LOCAL GOVERNMENT 13 ACT 1936 14 Act 15 Amended The Local Government Act 1936 is amended as set out in this Part. 16 Clause7. of s.4F (Meaning of "reviewable local government 17 Amendment matter") 18 Clause8.(1) Section 4F(1)(a) and (aa)-- 19 omit, insert-- 20 `(a) creating a new area, including, for example, creating a new area 21 from-- 22 (i) 2 or more areas that are abolished; or 23
7 Local Government Legislation Amendment (ii) an area that is abolished and a part of another area; or 1 (iii) a part of an area that is excluded from the area; or 2 (iv) a part of the State that is not part of an area; 3 (aa) naming a new area;'. 4 (2) Section 4F(1)(b)-- 5 omit `or other areas'. 6 (3) Section 4F(1)(e)-- 7 omit, insert-- 8 `(e) abolishing an area and merging the area with another area;'. 9 (4) Section 4F(1)(g)(i)-- 10 omit `or other divisions'. 11 (5) Section 4F(1)(g)(ii)-- 12 omit `or divisions'. 13 (6) After section 4F(1)(k)-- 14 insert-- 15 `(l) anything else relating to local government declared by regulation 16 to be a reviewable local government matter. 17 `(1A) A reference in this Act to a reviewable local government matter 18 includes a reference to-- 19 (a) any aspect of a matter mentioned in subsection (1); and 20 (b) a particular proposal in relation to a matter, or any aspect of a 21 matter, mentioned in subsection (1).'. 22 of s.4H (Functions of Commissioner) 23 Amendment After section 4H(2)-- 24 Clause9. insert-- 25 `(3) A reference may, for example, deal with-- 26 (a) a reviewable local government matter and another matter relating 27 to local government; or 28
8 Local Government Legislation Amendment (b) a local government matter that includes a reviewable local 1 government matter. 2 `(4) A reference need not separately identify any reviewable local 3 government matter dealt with in, or included in a local government matter 4 dealt with in, the reference. 5 `(5) A reference may deal with any local government matter in-- 6 (a) general or specific terms; or 7 (b) a combination of general and specific terms. 8 `(6) A reference may specify in any way a local government matter that 9 is referred to the Commissioner. 10 `(7) A reference may, for example, specify a local government matter 11 by-- 12 (a) naming the local authorities that the reference directly concerns; or 13 (b) describing in a suitable way the geographical area to which the 14 reference relates; or 15 (c) specifying with reasonable certainty things that are, or are not, 16 included in the reference. 17 Examples of suitable ways of describing a geographical area-- 18 1. By reference to real property descriptions. 19 2. By reference to a map or plan held by a person, department or 20 body, or a particular entry in a register kept by a person, 21 department or body, if the map, plan or register is available for 22 inspection by members of the public. 23 3. By reference to a region of the State that is identified, or can be 24 ascertained, with reasonable certainty. 25 4. By reference to areas of named local authorities. 26 5. By reference to a part of the area of a named local authority that is 27 identified, or can be ascertained, with reasonable certainty. 28 6. By reference to a report of the Parliamentary Committee for 29 Electoral and Administrative Review (the "Parliamentary 30 Committee"). 31 `(8) A reference may also, for example, refer to the Commissioner 32
9 Local Government Legislation Amendment anything relating to local government mentioned in a report of the 1 Parliamentary Committee. 2 `(9) A reference may make the reference of a local government matter 3 contingent on the recommendations that the Commissioner proposes to 4 make on another local government matter. 5 `(10) In subsections (5) to (9)-- 6 "local government matter" includes a reviewable local government 7 matter.'. 8 of s.4L (Assessment of impact of certain proposals) 9 Amendment Clause10. Section 4L (at the end)-- 10 insert-- 11 `(e) anything else prescribed by regulation.'. 12 of s.4N (Inquiries by Commissioner) 13 Replacement Section 4N-- 14 Clause11. omit, insert-- 15 by Commissioner 16 `Inquiries `4N.(1) The Commissioner may hold an inquiry for the purpose of a 17 reference that deals with a reviewable local government matter (whether or 18 not it also deals with, or is included in, another matter relating to local 19 government). 20 `(2) Before starting the inquiry, the Commissioner must publish a notice 21 outlining the processes that will be followed in the inquiry in a newspaper 22 circulating in the areas directly concerned in the reference.'. 23 of heading before s.5 (Areas) 24 Omission Clause12. 10 Local Government Legislation Amendment of s.5 (Classes of Areas) 1 Amendment Section 5(1)-- 2 Clause13.(1) omit, insert-- 3 `Implementation of reviewable local government matter 4 `5.(1) A reviewable local government matter may be implemented by 5 regulation. 6 `Facilitating provisions of regulation 7 `(2) A regulation for implementing a reviewable local government matter 8 may include provisions with respect to-- 9 (a) holding a fresh election for an area or a division of an area; and 10 (b) appointing a returning officer for a fresh election; and 11 (c) the recovery of unpaid rates, charges and levies; and 12 (d) the application of budgets; and 13 (e) delivering or retaining records; and 14 (f) the matters that the Commissioner is required to examine, and 15 report and make recommendations to the Minister on, under 16 section 4L; and 17 (g) the giving of directions by the Governor in Council or the 18 Minister with respect to any matter; and 19 (h) any other matter for which-- 20 (i) it is necessary or convenient to make provision to facilitate 21 the implementation of the reviewable local government 22 matter; and 23 (ii) this Act does not make provision or sufficient provision. 24 `(3) Subsections (1) and (2) do not apply to determining or changing the 25 system of voting for the local authority of an area.'. 26 (2) Section 5(1G)-- 27 omit `(1A)', insert `(4)'. 28 (3) Section 5(1H)-- 29 omit `(1A)', insert `(4)'. 30
