1994 A BILL FOR An Act to amend certain local government legislation
4 Local Government Legislation Amendment The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short This Act may be cited as the Local Government Legislation 4 Clause1. Amendment Act 1994. 5 6 Commencement Clause2. Part 2 is taken to have commenced on 1 February 1994. 7 ART 2--AMENDMENT OF CITY OF BRISBANE 8 P ACT 1924 9 amended 10 Act This Part amends the City of Brisbane Act 1924. 11 Clause3. of s 17 (Provisions concerning elections) 12 Amendment Clause4.(1) Section 17(5) and (6)-- 13 omit, insert-- 14 `(5) The Electoral Act applies to the conduct of elections with any 15 necessary changes and any changes prescribed by regulation. 16 `(6) For the purpose of applying the Electoral Act to elections-- 17 (a) the chief returning officer has the powers and functions of the 18 Electoral Commission and returning officers under the Electoral 19 Act; and 20 (b) returning officers have the powers and functions of returning 21
5 Local Government Legislation Amendment officers under the Electoral Act. 1 `(7) The chief returning officer may delegate the officer's powers under 2 this Act to a returning officer.'. 3 PART 3--AMENDMENT OF LOCAL GOVERNMENT 4 ACT 1993 5 amended 6 Act This Part amends the Local Government Act 1993. 7 Clause5. of s 2 (Commencement) 8 Amendment Section 2-- 9 Clause6. insert-- 10 `(1A) Chapter 13 (General), Part 3 (Postponement of certain local 11 government elections) commences on the day this subsection commences.'. 12 of new Chap 13, Pt 3 13 Insertion Clause7. After Chapter 13, Part 2-- 14 insert-- 15 `PART 3--POSTPONEMENT OF CERTAIN LOCAL 16 GOVERNMENT ELECTIONS 17 18 `Definitions `752A. In this Part-- 19 "affected local governments" means-- 20 (a) the Council of the City of Warwick; and 21 (b) the Council of the Shire of Allora; and 22
6 Local Government Legislation Amendment (c) the Council of the Shire of Glengallan; and 1 (d) the Council of the Shire of Rosenthal; 2 "relevant reviewable local government matters" means the reviewable 3 local government matters referred to the Commissioner under the 4 Local Government Act 1936 on 21 January 1994 about the affected 5 local governments' areas and parts of the Shire of Stanthorpe's area. 6 of affected local governments' elections 7 `Postponement `752B.(1) Despite section 217 (Date of next triennial elections), the 1994 8 triennial elections for the affected local governments are postponed pending 9 the making and consideration of the Commissioner's report on the relevant 10 reviewable local government matters. 11 `(2) The 1994 triennial elections for the affected local governments are to 12 be held on the date prescribed by regulation. 13 `(3) Subsection (2) is subject to the implementation of the relevant 14 reviewable local government matters. 15 of postponement of elections 16 `Effect `752C.(1) Anything done before the commencement of this Part for the 17 purposes of the 1994 triennial elections for the affected local governments is 18 of no effect. 19 20 Example-- 21 Nominations of candidates for election and postal ballots cast are of no effect. `(2) If a person has nominated as a candidate for an election, the 22 returning officer for the election must refund the candidate's deposit 23 accompanying the person's nomination. 24 `(3) If postal ballots have been cast in an election, the returning officer for 25 the election must destroy the used ballot papers. 26 day for voters rolls for postponed elections 27 `Cut-off `752D. Section 12D-- 17 omit `they', insert `it'.'. 18 (2) Schedule, after amendment 14 of the Building Act 1975-- 19 insert-- 20 `14A. Section 12E(5)-- 21 omit `clerk of the local authority', insert `local government'.'. 22 (3) Schedule, amendment 72 of the Building Act 1975-- 23 omit, insert-- 24
