1997 A BILL FOR An Act to amend legislation about local government

 


 

s1 4 s3 Local Government Legislation Amendment (No. 2) The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Local Government Legislation 4 Amendment Act (No. 2) 1997. 5 PART 2--AMENDMENT OF LOCAL GOVERNMENT 6 1993 7 amended in pt 2 8 Act Clause 2. This part amends the Local Government Act 1993. 9 of s 4 (Definitions) 10 Amendment Clause 3. Section 4-- 11 insert-- 12 ` "delayed implementation issues", for a reviewable local government 13 matter mentioned in section 64(1)(c), means-- 14 (a) the likely cost of conducting fresh elections that may be held 15 because of the implementation of the matter; and 16 (b) the period since the conduct of the last elections of all councillors 17 for the local governments affected by the matter; and 18 (c) the period before the conduct of the next triennial elections for the 19 local governments. 20 "delayed implementation determination", for a reviewable local 21 government matter, means a determination, under section 72G(1A) or 22

 


 

s4 5 s5 Local Government Legislation Amendment (No. 2) (1B) or section 73E(1A) or (1B), for the matter. 1 "delayed implementation reference", for a reviewable local government 2 matter, means a reference of a matter mentioned in section 64(1)(c), 3 for a local government whose area is divided, that-- 4 (a) does not include a matter mentioned in section 64(1)(g), (h), (i) or 5 (k); and 6 (b) the Minister states in the reference is a delayed implementation 7 reference.'. 8 of s 72D (Public notice of proposed determination to 9 Amendment implement matter) 10 Clause 4. Section 72D-- 11 insert-- 12 `(4A) If, in the proposed determination of the matter, the commission 13 proposes to adopt a margin of allowance under section 233(3) for the quota 14 of voters for each councillor for a division of a local government, the notice 15 must also state the margin of allowance to be adopted. 16 `(4B) If the commission proposes to make a delayed implementation 17 determination for the matter, the notice must also state-- 18 (a) the matter is to be implemented on the conclusion of the election, 19 at the next triennial elections, of all councillors for the local 20 governments affected by the determination to implement the 21 matter; and 22 (b) the elections are to be conducted as if the determination were 23 implemented.'. 24 of s 72G (Making final determination and preparation of 25 Amendment report) 26 Clause 5. Section 72G-- 27 insert-- 28 `(1A) If the matter is the subject of a delayed implementation reference 29

 


 

s5 6 s5 Local Government Legislation Amendment (No. 2) and the commission makes a determination to implement the matter, the 1 commission-- 2 (a) must determine the matter be implemented on the conclusion of 3 the election, at the next triennial elections, of all councillors for the 4 local governments affected by the determination to implement the 5 matter; and 6 (b) must determine not to implement a reviewable local government 7 matter mentioned in section 64(1)(g), (h), (i) or (k) for the local 8 governments or the local governments' areas. 9 `(1B) If the matter is a reviewable local government matter mentioned in 10 section 64(1)(c) (other than a matter the subject of a delayed implementation 11 reference) for a local government area that is divided, the commission may 12 determine the matter be implemented on the conclusion of the election, at 13 the next triennial elections, of all councillors for the local governments 14 affected by the determination only if-- 15 (a) the commission is satisfied it is appropriate to delay 16 implementing the matter having regard to the delayed 17 implementation issues for the matter; and 18 (b) the commission determines not to implement a reviewable local 19 government matter mentioned in section 64(1)(g), (h), (i) or (k) 20 for the local governments or the local governments' areas. 21 `(1C) Also, if the matter is a matter mentioned in section 64(1)(c) (the 22 "first matter") and the commission makes a determination to implement 23 the first matter, the commission may, if it is satisfied it is appropriate for 24 another reviewable local government matter mentioned in section 64(1)(g) 25 or (h) included in the reference of the first matter, make a determination to 26 implement the other matter only so far as the other matter relates to all of 27 the divisions of a local government area directly affected by the 28 determination of the first matter. 29 `(1D) However, subsection (1C) does not apply if the commission 30 makes a determination of a matter mentioned in section 64(1)(i) or (k) 31 included in the reference of the first matter. 32 `(1E) For subsection (1C), a division of a local government area is 33 directly affected by the determination of the first matter only if, under the 34 determination-- 35

 


 

s6 7 s7 Local Government Legislation Amendment (No. 2) (a) the division's boundaries are to be changed because of the 1 exclusion of part of the local government area (the "excluded 2 part") and including the excluded part in another local 3 government area; or 4 (b) the division adjoins the excluded part; or 5 (c) the division adjoins a division mentioned in paragraph (a) or (b).'. 6 of s 72H (Notification of determination and report to 7 Amendment Minister) 8 Clause 6. Section 72H(2)(c)-- 9 omit, insert-- 10 `(c) if the commission determines the matter be implemented--state 11 that the matter is to be implemented by regulation; and 12 (d) if the commission makes a delayed implementation determination 13 for the matter--state in general terms the effect of the 14 determination; and 15 (e) if section 72J applies to the matter--state in general terms the 16 effect of the section.'. 17 of s 72I (Implementation of matter on commission's 18 Amendment report) 19 Clause 7. Section 72I-- 20 insert-- 21 `(1A) However, if the commission makes a delayed implementation 22 determination for the matter-- 23 (a) the Governor in Council must implement the matter to 24 commence on the conclusion of the election, at the next triennial 25 elections, of all councillors for the local governments affected by 26 the determination; and 27 (b) a regulation implementing the matter must provide for the 28

Section 73C-- 5 `(2A) If, in the proposed determination of the matter, the commission 6 proposes to adopt a margin of allowance under section 233(3) for the quota 7 of voters for each councillor for a division of a local government, the notice 8 must also state the margin of allowance to be adopted. 9 `(2B) If the commission proposes to make a delayed implementation 10 determination for the matter, the notice must also state-- 11 (a) the matter is to be implemented on the conclusion of the election, 12 at the next triennial elections, of all councillors for the local 13 governments affected by the determination to implement the 14 matter; and 15 (b) the elections are to be conducted as if the determination were 16 implemented.'. 17 of s 73E (Making final determination and preparation of 18 Amendment report) 19 Clause 9. Section 73E-- 20 insert-- 21 `(1A) If the matter is the subject of a delayed implementation reference 22 and the commission makes a determination to implement the matter, the 23 commission-- 24 (a) must determine the matter be implemented on the conclusion of 25 the election, at the next triennial elections, of all councillors for the 26 local governments affected by the determination to implement the 27 matter; and 28 (b) must determine not to implement a reviewable local government 29 matter mentioned in section 64(1)(g), (h), (i) or (k) for the local 30

 


 

s9 9 s9 Local Government Legislation Amendment (No. 2) governments or the local governments' areas. 1 `(1B) If the matter is a reviewable local government matter mentioned in 2 section 64(1)(c) (other than a matter the subject of a delayed implementation 3 reference) for a local government area that is divided, the commission may 4 determine the matter be implemented on the conclusion of the election, at 5 the next triennial elections, of all councillors for the local governments 6 affected by the determination only if-- 7 (a) the commission is satisfied it is appropriate to delay 8 implementing the matter having regard to the delayed 9 implementation issues for the matter; and 10 (b) the commission determines not to implement a reviewable local 11 government matter mentioned in section 64(1)(g), (h), (i) or (k) 12 for the local governments or the local governments' areas. 13 `(1C) Also, if the matter is a matter mentioned in section 64(1)(c) (the 14 "first matter") and the commission makes a determination to implement 15 the first matter, the commission may, if it is satisfied it is appropriate for 16 another reviewable local government matter mentioned in section 64(1)(g) 17 or (h) included in the reference of the first matter, make a determination to 18 implement the other matter only so far as the other matter relates to all of 19 the divisions of a local government area directly affected by the 20 determination of the first matter. 21 `(1D) However, subsection (1C) does not apply if the commission 22 makes a determination of a matter mentioned in section 64(1)(i) or (k) 23 included in the reference of the first matter. 24 `(1E) For subsection (1C), a division of a local government area is 25 directly affected by the determination of the first matter only if, under the 26 determination-- 27 (a) the division's boundaries are to be changed because of the 28 exclusion of part of the local government area (the "excluded 29 part") and including the excluded part in another local 30 government area; or 31 (b) the division adjoins the excluded part; or 32 (c) the division adjoins a division mentioned in paragraph (a) or (b).'. 33

 


 

s 10 10 s 13 Local Government Legislation Amendment (No. 2) of s 73F (Notification of determination and report to 1 Amendment Minister) 2 Clause 10. Section 73F(2)-- 3 insert-- 4 `(d) if the commission makes a delayed implementation determination 5 for the matter--state in general terms the effect of the 6 determination.'. 7 of s 73G (Implementation of matter) 8 Amendment Clause 11. s 14 11 s 14 Local Government Legislation Amendment (No. 2) renumber as section 106(2)(k). 1 (2) Section 106(2)-- 2 insert-- 3 `(j) in the case of a reviewable local government matter the subject of 4 a delayed implementation determination--payment by a local 5 government for not adequately supplying services and facilities in 6 the interim period for the matter in a part of a local government 7 area that, under the matter, has been, or is to be, transferred from 8 1 local government area to another local government area; or'. 9 (3) Section 106-- 10 insert-- 11 `(2A) Subsection (2)(a) has effect subject to section 350(2A).1'. 12 (4) Section 106(5)-- 13 insert-- 14 ` "interim period", for a reviewable local government matter the subject of 15 a delayed implementation determination, means the period from the 16 notification of the determination by gazette notice to the conclusion of 17 the election, at the next triennial elections, of all councillors for the local 18 governments affected by the determination.'. 19 of s 233 (Quota to be complied with in division of local 20 Amendment government area and assignment of councillors) 21 Clause 14. Section 233(3) and (4)-- 22 omit, insert-- 23 `(3) Also, an electoral and boundaries review commission may, if it is 24 satisfied it is appropriate in its determination, under section 72G(1C) or 25 73E(1C), of a reviewable local government matter, adopt a margin of 26 allowance, but the quota must not be departed from-- 27 (a) for a local government area with more than 10 000 electors--by 28 1 Section 350 (Requirements for fresh election)

 


 

s 15 12 s 15 Local Government Legislation Amendment (No. 2) not more than 20%; or 1 (b) for another local government area--by not more than 40%. 2 `(4) However, a commission must not make a determination under 3 subsection (3) in the period starting on the information date mentioned in 4 section 234 for a local government and ending on the date of the next 5 triennial elections. 6 `(5) Also, subsection (3) does not apply if-- 7 (a) the reference for the matter includes a reviewable local 8 government matter mentioned in section 64(1)(a) or (f); or 9 (b) the matter is referred to the commissioner under section 235. 10 `(6) For subsection (2), the quota must be worked out as near as 11 practicable to-- 12 (a) if the matter is a reviewable local government matter (other than a 13 limited reviewable local government matter)--the time notice of 14 the proposed determination of the matter is given under 15 section 72D or 73C; or 16 (b) if the matter is a limited reviewable local government matter--the 17 time notification in the gazette of the determination of the matter 18 is given under section 78. 19 `(7) For subsection (3), the quota must be worked out as near as 20 practicable to the time notice of the proposed determination of the matter is 21 given under section 72D or 73C.'. 22 of s 234 (Disclosure of compliance or noncompliance with 23 Amendment quota requirements) 24 Clause 15.(1) Section 234(1), `233'-- 25 omit, insert-- 26 `233(2)'. 27 (2) Section 234-- 28 insert-- 29 `(2A) However, subsection (1) does not apply to a local government, 30

 


 

s 16 13 s 16 Local Government Legislation Amendment (No. 2) if-- 1 (a) an electoral and boundaries review commission has made a 2 delayed implementation determination for a reviewable local 3 government matter for the local government's area; and 4 (b) the determination was made after the conduct of the last election 5 of all councillors for the local governments affected by the 6 determination.'. 7 of s 235 (Matter of area's division referred to 8 Amendment commissioner) 9 Clause 16.(1) Section 235(a), `233'-- 10 omit, insert-- 11 `233(2)'. 12 (2) Section 235-- 13 insert-- 14 `(2) Also, the Minister must refer the matter of the division of a local 15 government's area to the commissioner-- 16 (a) if-- 17 (i) an electoral and boundaries review commission has made a 18 determination, under section 72G(1C) or 73E(1C), for a 19 reviewable local government matter for the area; or 20 (ii) an electoral and boundaries review commission has made a 21 delayed implementation determination for a reviewable local 22 government matter for the area; and 23 (b) the determination was made since the conduct of the last election 24 of all councillors for the local governments affected by the 25 determination. 26 `(3) A reference under subsection (2) must be made as soon as 27 practicable after the information date for the local government.'. 28
