2003 A BILL FOR An Act to provide for making available updated fiscal and economic information pending a general election

 


 

s1 4 s5 Pre-election Budget Honesty Bill 2003 The Parliament of Queensland enacts-- 1 1 Short title 2 This Act may be cited as the Pre-election Budget Honesty Act 2003. 3 2 Dictionary 4 The dictionary in the schedule defines particular words used in this Act. 5 3 Public release of pre-election fiscal and economic outlook report 6 The chief executive must publicly release a pre-election fiscal and 7 economic outlook report within 10 days of the issue of the writ for a 8 general election. 9 4 Purpose of pre-election fiscal and economic outlook reports 10 The purpose of a pre-election fiscal and economic outlook report is to 11 provide updated information on the fiscal and economic outlook of the 12 State. 13 5 Contents of pre-election fiscal and economic outlook 14 report--fiscal and economic information 15 (1) A pre-election fiscal and economic outlook report must contain the 16 following information-- 17 (a) updated fiscal estimates for the current financial year for the 18 Queensland general government and public trading enterprise 19 budget sectors of the type usually provided in the Mid Year Fiscal 20 and Economic Review; 21 (b) the economic and other assumptions for the current financial year 22 used in preparing the updated fiscal estimates; 23 (c) an updated statement of the risks, quantified if feasible, that may 24 have a material effect on the fiscal and economic outlook, 25 including-- 26 (i) contingent liabilities; and 27

 


 

s6 5 s6 Pre-election Budget Honesty Bill 2003 (ii) publicly announced Government commitments; and 1 (iii) Government negotiations that have yet to be finalised. 2 (2) To the fullest extent possible, the information in the report is to take 3 into account all Government decisions and other circumstances that-- 4 (a) may have a material effect on the fiscal and economic outlook; 5 and 6 (b) were made, or were in existence, before the issue of the writ for 7 the general election. 8 (3) The report is to-- 9 (a) be based on external reporting standards; and 10 (b) identify, in general terms, the external reporting standards on 11 which it is based and any ways in which the report departs from 12 the standards. 13 (4) If particular information required to be included in the report is 14 unchanged from information set out in full in the Mid Year Fiscal and 15 Economic Review tabled in the Legislative Assembly, the report may 16 instead summarise the information and state that it is unchanged from what 17 was set out in the review. 18 (5) The report does not have to include information that the chief 19 executive reasonably considers should not be included because it is 20 confidential commercial information. 21 6 Contents of pre-election fiscal and economic outlook 22 report--statements by Ministers and the chief executive 23 A pre-election fiscal and economic outlook report is to contain the 24 following-- 25 (a) a signed statement, by each Minister, that the disclosure 26 requirements of section 7 have been complied with; 27 (b) a signed statement by the chief executive to the effect that, to the 28 fullest extent possible, the information in the report-- 29 (i) reflects the best professional judgment of officers of the 30 chief executive's department; and 31 (ii) takes into account all fiscal and economic information 32 available; and 33

 


 

s7 6 s9 Pre-election Budget Honesty Bill 2003 (iii) incorporates the fiscal and economic implications of 1 Government decisions and circumstances disclosed by 2 Ministers. 3 7 Each Minister must provide information to help prepare report 4 (1) To help the chief executive prepare a pre-election fiscal and 5 economic outlook report, each Minister must disclose to the chief executive 6 details of any Government decision, or any other circumstance, that the 7 Minister knows about-- 8 (a) that has, or could have, material fiscal or economic implications; 9 and 10 (b) that the chief executive could not reasonably be expected to 11 know about. 12 (2) Disclosures are to be made within 2 days of the issue of the writ for 13 the general election. 14 8 State body must provide information to help prepare report 15 (1) To help the chief executive prepare a pre-election fiscal and 16 economic outlook report, the chief executive may ask a State body to 17 provide information. 18 (2) The State body must comply with the request in time to allow the 19 information to be taken into account in the preparation of the report, unless 20 it is not practicable for the body to do so. 21 (3) The State body does not have to provide information if doing so 22 would contravene a law of the State. 23 9 Meaning of "GFS Australia" 24 (1) "GFS Australia" is the publication of the Australian Bureau of 25 Statistics known as Government Finance Statistics Australia: Concepts, 26 Sources and Methods, as updated from time to time. 27 (2) This updating takes either of the following forms-- 28 (a) a new version of the publication is produced; 29 (b) material in the current version of the publication is updated by 30 other publications of the Australian Bureau of Statistics. 31

 


 

7 Pre-election Budget Honesty Bill 2003 SCHEDULE 1 DICTIONARY 2 section 2 3 "charter of social and fiscal responsibility" means the charter prepared 4 by the Treasurer under the Financial Administration and Audit Act 5 1977, part 1A. 6 "chief executive" means the chief executive of the department in which the 7 Mid Year Fiscal and Economic Review is prepared. 8 "external reporting standards" means the concepts and classifications set 9 out in GFS Australia. 10 "general election" means an election for the members of the Legislative 11 Assembly. 12 "GFS Australia" see section 9. 13 "Government" means the Government of the State. 14 "Mid Year Fiscal and Economic Review" means the document by that 15 name that is prepared under the charter of social and fiscal 16 responsibility. 17 "State body" means a department, or statutory body, under the Financial 18 Administration and Audit Act 1977. 19
