1996 A BILL FOR An Act to amend the Parliamentary Committees Act 1995, and for other purposes
s1 4 s3 Parliamentary Committees Legislation Amendment The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Parliamentary Committees Legislation 4 Amendment Act 1996. 5 PART 2--AMENDMENT OF PARLIAMENTARY 6 COMMITTEES ACT 1995 7 amended in pt 2 8 Act Clause 2. This part amends the Parliamentary Committees Act 1995. 9 of new ss 4A and 4B 10 Insertion Clause 3. After section 4-- 11 insert-- 12 of statutory committees 13 `Membership `4A.(1) A statutory committee must consist of an equal number of 14 members nominated by-- 15 (a) the member who is recognised in the Legislative Assembly as the 16 Leader of the House; and 17 (b) the member who is recognised in the Legislative Assembly as the 18 Leader of the Opposition. 19 `(2) The chairperson of a statutory committee must be the member 20 nominated as chairperson by the member mentioned in subsection (1)(a). 21

At a meeting of a statutory committee-- 2 (a) a quorum consists of half the number of members appointed to 3 the committee plus 1; and 4 (b) a question is decided by a majority of the votes of the members 5 of the committee present and voting; and 6 (c) each member of the committee has a vote on each question to be 7 decided and, if the votes are equal, the chairperson of the 8 committee has a casting vote. 9 10 Example of paragraph (a)-- 11 If 6 members are appointed to a statutory committee, the quorum is 4 (half the 12 number of members (3) plus 1).'. of s 6 (Application of Act to committees established by 13 Amendment Assembly etc.) 14 Clause 4. Section 6(3)-- 15 omit, insert-- 16 `(3) This Act does not apply to the Criminal Justice Committee.'. 17 of s 20 (Areas of responsibility of Public Works 18 Amendment Committee) 19 Clause 5. s7 6 s8 Parliamentary Committees Legislation Amendment to call for persons etc. 1 `Power `25. A statutory committee is, by this section, authorised to call for 2 persons, documents and other things.'. 3 of s 37 (Legal, Constitutional and Administrative 4 Replacement Review Committee to take over unfinished issues from Parliamentary 5 Criminal Justice Committee) 6 Clause 7. Section 37-- 7 omit, insert-- 8 Justice Committee to take over certain unfinished issues 9 `Criminal `37.(1) This section applies if the Legal, Constitutional and 10 Administrative Review Committee has not tabled a report about an issue 11 that it started considering and-- 12 (a) the Parliamentary Criminal Justice Committee had previously 13 started to consider, but not tabled a report, about the issue; or 14 (b) the issue is otherwise within the functions of the Criminal Justice 15 Committee. 16 `(2) The Criminal Justice Committee may deal with the issue as if it had 17 exclusively dealt with the issue from the beginning.'. 18 ART 3--AMENDMENT OF CRIMINAL JUSTICE 19 P ACT 1989 20 amended in pt 3 21 Act Clause 8. This part amends the Criminal Justice Act 1989. 22
s9 7 s 10 Parliamentary Committees Legislation Amendment of s 3 (Definitions) 1 Amendment Clause 9. Section 3, definition "parliamentary committee"-- 2 omit, insert-- 3 ` "parliamentary committee" means the Criminal Justice Committee of 4 the Legislative Assembly.'. 5 of new ss 115-117 6 Insertion Clause 10. Part 4, before section 118-- 7 insert-- 8 of parliamentary committee 9 `Establishment `115. A committee of the Legislative Assembly called the Criminal 10 Justice Committee is established. 11 of parliamentary committee 12 `Membership `116.(1) The parliamentary committee must consist of an equal number 13 of members nominated by-- 14 (a) the member who is recognised in the Legislative Assembly as the 15 Leader of the House; and 16 (b) the member who is recognised in the Legislative Assembly as the 17 Leader of the Opposition. 18 `(2) The chairperson of the parliamentary committee must be the 19 member nominated as chairperson by the member mentioned in 20 subsection (1)(a). 21 and voting at meetings of parliamentary committee 22 `Quorum `117. ART 4--AMENDMENT OF ELECTORAL ACT 1992 7 P amended in pt 4 8 Act Clause 11. This part amends the Electoral Act 1992. 9 of s 7 (Establishment of Electoral Commission of 10 Amendment Queensland etc.) 11 Clause 12. Section 7(7)-- 12 omit, insert-- 13 `(7) A person may be appointed as the chairperson or nonjudicial 14 appointee only if the Minister has consulted-- 15 (a) with each member of the Legislative Assembly recognised as the 16 leader of a political party represented in the Assembly about the 17 proposed appointment; and 18 (b) with the parliamentary committee about-- 19 (i) the process of selection for appointment; and 20 (ii) the appointment of the person as the chairperson or 21 nonjudicial appointee.'. 22
s 13 9 s 13 Parliamentary Committees Legislation Amendment of s 23 (Terms and conditions of appointment etc.) 1 Amendment Clause 13. Section 23(2)-- 2 omit, insert-- 3 `(2) A person may be appointed as a senior electoral officer only if-- 4 (a) press advertisements have been placed nationally calling for 5 applications from suitably qualified persons to be considered for 6 appointment; and 7 (b) the Minister has consulted-- 8 (i) with each member of the Legislative Assembly recognised 9 as the leader of a political party represented in the Assembly 10 about the proposed appointment; and 11 (ii) with the parliamentary committee about-- 12 (A) the process of selection for appointment; and 13 (B) the appointment of the person as the senior electoral 14 officer.'. 15 16 � State of Queensland 1996
