2011 A Bill for An Act to amend the Auditor-General Act 2009, Criminal Organisation Act 2009, Electoral Act 1992, Information Privacy Act 2009, Integrity Act 2009, Legislative Standards Act 1992, Ombudsman Act 2001, Parliament of Queensland Act 2001 and Right to Information Act 2009 for particular purposes
Parliament of Queensland (Reform and Modernisation) Amendment Bill 2011 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Parliament of Queensland 4 (Reform and Modernisation) Amendment Act 2011. 5 Clause 2 Commencement 6 (1) The following provisions are taken to have commenced on 10 7 March 2011-- 8 · part 3 heading 9 · part 3, division 1 10 · section 43(1) 11 · section 44, to the extent it inserts new-- 12 · part 5 heading 13 · section 169, other than section 169(3) 14 · section 173 15 · section 45(2), to the extent it inserts new definition 16 Manager of Opposition Business. 17 (2) The following provisions commence on assent-- 18 · part 2 19 · part 3, division 2 20 · section 44, to the extent it inserts new section 169(3). 21 (3) The remaining provisions of this Act commence on a day to 22 be fixed by proclamation. 23 Page 6

Parliament of Queensland (Reform and Modernisation) Amendment Bill 2011 Part 3 Amendment of Parliament of Queensland Act 2001 [s 6] Part 3 Amendment of Parliament of 1 Queensland Act 2001 2 Division 1 Preliminary 3 Clause 6 Act amended 4 This part amends the Parliament of Queensland Act 2001. 5 Division 2 Amendments commencing on 6 assent 7 Clause 7 Insertion of new ch 5, pt 1A 8 Chapter 5-- 9 insert-- 10 `Part 1A Committee of the Legislative 11 Assembly 12 `Division 1 Establishment and operation 13 `79A Establishment 14 `The Committee of the Legislative Assembly is established. 15 `79B Membership 16 `(1) The committee comprises the following members-- 17 (a) the Leader of the House or alternate; 18 (b) the Premier or alternate; 19 (c) the Deputy Premier or alternate; 20 (d) the Manager of Opposition Business or alternate; 21 Page 8
Parliament of Queensland (Reform and Modernisation) Amendment Bill 2011 Part 3 Amendment of Parliament of Queensland Act 2001 [s 7] (e) the Leader of the Opposition or alternate; 1 (f) the Deputy Leader of the Opposition or alternate; 2 (g) when the committee is dealing with a matter relating to 3 the standing rules and orders--the Speaker. 4 `(2) In this section-- 5 alternate, in relation to a member, means another member of 6 the Assembly nominated by the first member to perform the 7 first member's role as a member of the committee. 8 `79C Chairperson 9 `The Leader of the House is to be the chairperson of the 10 committee. 11 `79D Quorum and voting at meetings 12 `At a meeting of the committee-- 13 (a) a quorum is 4 members other than the Speaker; and 14 (b) a question is decided by a majority of the votes of the 15 members present and voting; and 16 (c) each member has a vote on each question to be decided 17 and, if the votes are equal, the chairperson has a casting 18 vote. 19 `Division 2 Role of committee 20 `79E Areas of responsibility 21 `The committee has the following areas of responsibility-- 22 (a) the ethical conduct of members; 23 Note-- 24 However, under section 92(3), a complaint about a particular 25 member not complying with the code of ethical conduct for 26 Page 9
Parliament of Queensland (Reform and Modernisation) Amendment Bill 2011 Part 3 Amendment of Parliament of Queensland Act 2001 [s 7] members may be considered only by the Assembly or the 1 Integrity, Ethics and Parliamentary Privileges Committee. 2 (b) parliamentary powers, rights and immunities; 3 (c) standing rules and orders about the conduct of business 4 by, and the practices and the procedures of, the 5 Assembly and its committees; 6 (d) any other matters for which the committee is given 7 responsibility under the standing rules and orders. 8 `79F Ethical conduct--registration of interests 9 `The committee's area of responsibility about the ethical 10 conduct of members includes-- 11 (a) examining the arrangements, under resolutions or the 12 standing rules and orders of the Assembly, for 13 compiling, keeping and allowing inspection of-- 14 (i) a register of the interests of members; and 15 (ii) a register of the interests of persons related to 16 members; and 17 (b) considering proposals made by members and other 18 persons about the form and content of the registers and 19 documents relevant to the registers, including statements 20 of interests to be made by members; and 21 (c) considering the classes of person who should be treated 22 as related to a member; and 23 (d) publishing explanatory information about the 24 requirements to register interests; and 25 (e) any other responsibility about the registration of 26 interests the Assembly may order the committee to 27 have; and 28 (f) considering any other issue about the registration of 29 interests. 30 Page 10
Parliament of Queensland (Reform and Modernisation) Amendment Bill 2011 Part 3 Amendment of Parliament of Queensland Act 2001 [s 7] `79G Ethical conduct--code of conduct 1 `(1) The committee's area of responsibility about the ethical 2 conduct of members includes-- 3 (a) publishing and reviewing a code of ethical conduct for 4 members (other than members in their capacity as 5 Ministers), including procedures for complaints about a 6 member not complying with the code; and 7 (b) the reform of legislation and standing rules and orders 8 about the ethical conduct of members, including the 9 registration or declaration of interests; and 10 (c) publishing explanatory information about the 11 obligations of members about their ethical conduct; and 12 (d) any other responsibility about the ethical conduct of 13 members the Assembly may order the committee to 14 have. 15 `(2) In reviewing the code of ethical conduct for members, the 16 committee must have regard to-- 17 (a) the ethics principles and values set out in the Public 18 Sector Ethics Act 1994; and 19 (b) the desirability of consistency between standards in the 20 code of ethical conduct and the ethics principles and 21 values, to the extent the principles and values are 22 relevant to members and their functions. 23 `79H Parliamentary powers, rights and immunities 24 `The committee's area of responsibility about parliamentary 25 powers, rights and immunities includes the powers, rights and 26 immunities of the Assembly and its committees and 27 members.'. 28 Page 11
