2003 A BILL FOR An Act to amend the Parliament of Queensland Act 2001
s1 4 s4 Parliament of Queensland (Change of Political Status) Bill 2003 The Parliament of Queensland enacts-- 1 1 Short title Clause 2 This Act may be cited as the Parliament of Queensland (Change of 3 Political Status) Act 2003. 4 2 Act amended Clause 5 This Act amends the Parliament of Queensland Act 2001. 6 3 Amendment of s 72 (Vacating seats of members in particular Clause 7 circumstances) 8 (1) Section 72(1)(n)-- 9 renumber as section 72(1)(o). 10 (2) Section 72(1)-- 11 insert-- 12 `(n) section 72A applies;'. 13 4 Insertion of new s 72A Clause 14 After section 72-- 15 insert-- 16 `72A Vacating seats of members if change of political status 17 `(1) A member's seat in the Assembly also becomes vacant if-- 18 (a) for a member who was elected as the candidate of a political 19 party--the member resigns as a member of the party or becomes 20 a member of another political party; or 21 (b) for a member who was elected as an independent member--the 22 member becomes a member of a political party. 23 `(2) For subsection (1)(a)-- 24
s4 5 s4 Parliament of Queensland (Change of Political Status) Bill 2003 (a) a member is taken to have been elected as the candidate of a 1 political party if, when the member was last elected-- 2 (i) the party's name or abbreviation was printed on the ballot 3 paper adjacent to the candidate's name; or 4 (ii) the member was publicly recognised by the party as being 5 an endorsed candidate of the party and publicly represented 6 himself or herself to be an endorsed candidate of the party; 7 and 8 (b) a member elected as the candidate of a political party is not taken 9 to have become a member of another political party only because 10 of a change in the name of the political party. 11 `(3) For subsection (1)(b), a member is taken to have been elected as an 12 independent member if, when the member was last elected, the member 13 publicly represented himself or herself to be independent. 14 `(4) In this section-- 15 "member", of a political party, see the Electoral Act 1992, section 3. 16 "political party" see the Electoral Act 1992, section 3.'. 17 18
