2007 A Bill for an Act to amend the Plant Protection Act 1989

 


 

s1 4 s3 Plant Protection Amendment Bill 2007 The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Plant Protection Amendment Act 3 2007. 4 Clause 2 Act amended 5 This Act amends the Plant Protection Act 1989. 6 Clause 3 Amendment of s 11A (Approved plant variety) 7 (1) Section 11A(1)(a), `the pest quarantine area'-- 8 omit, insert-- 9 `a pest quarantine area (the relevant quarantine area)'. 10 (2) Section 11A(1)(b), (3), and 8(a), `pest quarantine area'-- 11 omit, insert-- 12 `relevant quarantine area'. 13 (3) Section 11A(3), `pest to a crop'-- 14 omit, insert-- 15 `pest the subject of the relevant quarantine area (the 16 quarantine area pest) to a crop'. 17 (4) Section 11A(4), `subsection (3)'-- 18 omit, insert-- 19 `subsection (1)'. 20 (5) Section 11A(4)(a), (b) and (c)(i) and (iii), `pest'-- 21 omit, insert-- 22 `quarantine area pest'. 23 (6) Section 11A-- 24 insert-- 25

 


 

s3 5 s3 Plant Protection Amendment Bill 2007 `(4A) Subsections (3) and (4), other than the requirement to 1 consider relevant circumstances under subsection (4)(c), do 2 not apply if the chief executive is satisfied it is no longer 3 possible to prevent or control the spread of the quarantine area 4 pest in Queensland. 5 `(4B) If all of Queensland is the subject of a pest quarantine area for 6 any pest, an approved plant declaration may be made even if 7 the planting or cultivating of an approved plant variety under 8 the declaration may spread the pest to a crop plant within the 9 relevant quarantine area.'. 10 © State of Queensland 2007
