An Act to prohibit the sale of certain soft drinks at Queensland

The Parliament of Queensland enacts--                                         1



1     Short title                                                             2
          This Act may be cited as the Soft Drinks (Prohibition From          3
          Selling at Schools) Act 2005.                                       4

2     Commencement                                                            5
          This Act commences on a day to be fixed by proclamation.            6

3     Selling soft drinks at school premises prohibited                       7
     (1) A person must not sell a soft drink at school premises.              8
          Maximum penalty--                                                   9
          (a)   for an individual--1 penalty unit; or                         10
          (b)   for a corporation--10 penalty units.                          11
     (2) Subsection (1) does not apply to a person who--                      12
          (a)   hires the whole or part of school premises for an activity    13
                outside of the school hours of the school; and                14
          (b)   sells a soft drink at the premises in the course of the       15
                activity.                                                     16
     (3) In this section--                                                    17
          at, in relation to premises, includes in or on the premises.        18
          non-State school means a school that is provisionally               19
          accredited, or accredited, under the Education (Accreditation       20
          of Non-State Schools) Act 2001.                                     21
          premises includes a building together with surrounding land.        22
          school hours, of a school, means the hours in which the             23
          school is open as a school.                                         24
          school premises means the premises of a State educational           25
          institution or non-State school.                                    26

                              2005


     soft drink means an aerated drink containing--                  1
     (a)   at least 5 grams of sugar for each 100 mL of the drink;   2
           or                                                        3
     (b)   artificial sweetener.                                     4
     State educational institution see the Education (General        5
     Provisions) Act 1989, section 2(1).                             6
