PART 1--PRELIMINARY 2
1 Short title 3
This Act may be cited as the Water Infrastructure Development (Burnett 4
Basin) Act 2001. 5
2 Definitions 6
The dictionary in the schedule defines particular words used in this Act. 7
3 Act binds all persons 8
This Act binds all persons, including the State, and, in so far as the 9
legislative power of the State permits, the Commonwealth and the other 10
States. 11
PART 2--THE PROJECT, PRINCIPAL COMPONENT 12
AND EIS 13
4 Meaning of "the project" 14
"The project" is the investigation into the feasibility of carrying out the 15
following works-- 16
(a) the principal component; 17
(b) upgrading the existing Jones weir; 18
(c) new weirs at Barlil and Eidsvold. 19

5 Meaning of "principal component" 1
The "principal component" is significant new and upgraded water 2
storage and distribution infrastructure for cane irrigation in the Burnett 3
Basin. 4
6 Principal component a significant project 5
The principal component is a significant project under the State 6
Development and Public Works Organisation Act 1971, section 29B. 7
7 Proponent must prepare an EIS for the principal component 8
The proponent is, for the principal component, the proponent required to 9
prepare an EIS under the State Development and Public Works 10
Organisation Act 1971. 11
8 Terms of reference for the EIS 12
(1) The aspects of the B2K terms of reference that deal with the principal 13
component are-- 14
(a) the terms of reference for the EIS to be prepared by the 15
proponent under the State Development and Public Works 16
Organisation Act 1971 for the principal component; and 17
(b) taken to no longer be part of the B2K terms of reference. 18
(2) The State Development and Public Works Organisation Act 1971, 19
sections 29E and 29F-- 20
(a) were complied with in preparing the B2K terms of reference; and 21
(b) do not apply for the principal component. 22

9 Application of pt 3 2
This part applies only to an application by the proponent under the State 3
Development and Public Works Organisation Act 1971, section 91C, in 4
relation to the project. 5
10 Relationship with State Development and Public Works 6
Organisation Act 1971 7
(1) Entry to land by the proponent for investigations in relation to the 8
application is taken to be entry under the State Development and Public 9
Works Organisation Act 1971, part 6, division 6. 10
(2) The State Development and Public Works Organisation Act 1971, 11
section 91C(1) and (3), and any guidelines relating to the subsections, do 12
not apply to the application.1 13

This Act expires on 31 December 2004. 16

"B2K terms of reference" means the terms of reference for an EIS for the 4
Bundaberg 2000+ Project finalised by the Coordinator-General in 5
May 2000 and publicly released in June 2000.2 6
"EIS" means an environmental impact statement. 7
"principal component" see section 5. 8
"proponent" means a company-- 9
(a) all the shares in which are wholly owned by the State; and 10
(b) registered under the Corporations Law. 11
"the project" see section 4. 12
