                       EXPLANATORY NOTE

GENERAL OUTLINE


Objective of the Legislation
  The objective of this Bill is to clarify the means by which an Instant
Casket ticket is deemed to be a winning Instant Casket ticket and to remove
any potential ambiguity that could be used against the Golden Casket Art
Union Office for games conducted prior to the enactment of this Bill.
   The Bill will also give retrospective meaning to the term `match 3
numbers and win' (and similar phrases) to prevent any unintended windfall
through a mis-interpretation of instructions to players of Instant Casket
games.


Reasons for the Bill
  It has become evident that the instructions to Instant Casket players may
be ambiguous, particularly the meaning of the term `match 3 numbers and
win'. In some instances the term could mean `pair 3 numbers and win'.
   The Instant Casket has been operating in Queensland since 1984 and
since that time the generally accepted meaning of the term `match 3
numbers and win' has been to `find the same number 3 times and win'.


Estimated Cost for Government Implementation
  There will be no cost for Government.

 


 

2 Golden Casket Art Union Amendment Bill 1993 Consultation The Solicitor-General of Queensland, Queensland Crown Solicitor and Queensland Parliamentary Counsel have supported this Bill. NOTES ON PROVISIONS Clause 1. sets out the short title of the Bill. Clause 2. sets out the Act that will be amended by this Bill. Clause 3. defines the terms `Instant Casket' and `symbol' to clarify the Bill's application. The Bill applies to all Instant Casket tickets that were distributed by sale or otherwise prior to this Bill being enacted. Sub-clauses (5) and (6) apply to Instant Casket tickets that used the word `match' in instructions to players to determine if the ticket is a winning ticket. Examples of a winning and losing ticket are provided to demonstrate the meaning of the term `Match 3 numbers and win'. Sub-clause (7) indicates that a caption, which is sometimes printed beneath a symbol on an Instant Casket ticket, is clarification of the symbol and should not be interpreted as a separate symbol. For example, within the panel of an Instant Casket ticket the symbol and respective caption may be, but is not restricted to: SYMBOL CAPTION $1500 FIFTEEN $100 HUNDRED $2500 25HUNDRED 250000 250THOUSAND © The State of Queensland 1993
