EDUCATION (ACCREDITATION OF NON-STATE SCHOOLS) ACT 2001 - SECT 64
Show cause notice
(1) This section applies if— (a) the board reasonably believes a ground
exists to cancel a school’s accreditation; and
(b) the board— (i) has not
given, and does not propose to give, the school’s governing body a
compliance notice under section 61 to rectify a matter to which the ground
relates; or
(ii) has given the governing body a compliance notice under
section 61 to rectify a matter to which the ground relates and the governing
body— (A) has failed to comply with the compliance notice within the period
stated in the notice; and
(B) does not have a reasonable excuse for the
failure.
(2) The board must give the governing body a notice (a
"show cause notice" ) stating the following— (a) the action (the
"proposed action" ) the board proposes taking under this division;
(b) the
grounds for the proposed action;
(c) an outline of the facts and
circumstances forming the basis for the grounds;
(d) an invitation to the
governing body to show within a stated period (the
"show cause period" ) why the proposed action should not be taken.
(3) The
show cause period must be a period ending at least 30 days after the
show cause notice is given to the governing body.
