CIVIL LIABILITY INDEXATION NOTICE 2024 - REG 6

6 Amounts prescribed under particular former provisions of Act—Act, s 89

(1) This section and schedule 1 state information for section 89 (3) of the Act .

(2) An amount stated in column 2 of the table in schedule 1 , part 1 was prescribed, under former section 58 (1) (b) of the Act , for an injury that arose during the period stated opposite in column 1 of the table.

(3) Under former section 62 (2) of the Act , general damages for an injury, within the injury scale value stated in column 1 of a relevant table in schedule 1 , part 2 , were the sum of—

(a) the base amount (if any) stated opposite in column 2 of the relevant table; and

(b) the variable amount worked out in the way stated opposite in column 3 of the relevant table.

(4) An amount stated in column 2 of the table in schedule 1 , part 3 was prescribed, under former section 64 (2) of the Act , for an injury that arose during the period stated opposite in column 1 of the table.

(5) In this section—

"former" , for a provision of the Act , means the provision as in force immediately before the commencement of the Justice and Other Legislation Amendment Act 2023 , part 5 .

"relevant table" , in relation to an injury, means the table in schedule 1 , part 2 for the period during which the injury arose.
