Power to require personal details
71 Power to require personal details
(1) This section applies if an authorised officer— (a) finds a person
committing an offence against this regulation; or
(b) finds a person in
circumstances that lead the authorised officer to reasonably suspect the
person has just committed an offence against this regulation; or
(c) has
information that leads the authorised officer to reasonably suspect a person
has just committed an offence against this regulation.
(2) The authorised
officer may require the person to state the person’s name and— (a)
residential or business address; or
(b) if the person is temporarily in the
State—an address for the person in the State.
(3) The authorised officer
may also require the person to give evidence of the correctness of the stated
name or address if the authorised officer reasonably suspects the stated name
or address is false.
(4) When making a requirement under this section, the
authorised officer must give the person an offence warning for the
requirement.
