99 Deciding applications
(1) The chief executive must consider an application made under section 97 in
relation to a boat harbour approval and decide— (a) to approve the payment
arrangement with or without conditions; or
(b) to refuse to approve the
application.
(2) The chief executive may approve the payment arrangement only
if satisfied payment of the fee would cause, or would be likely to cause,
financial hardship to the holder of the boat harbour approval.
(3) The chief
executive must give the holder written notice of the decision.
(4) If the
chief executive decides to refuse to approve the application, or to approve
the payment arrangement with conditions, the chief executive must give the
holder an information notice for the decision.
(5) If the chief executive
approves the payment arrangement, the fees stated in the arrangement must be
paid in the way and on or before the day stated in the arrangement.
(6)
Subsection (5) applies despite section 96 (1) and (2) .
