(1) Before acting under section 121E (1) (a) , the chief executive must—(a) give the person a notice (a
"show cause notice" ) stating—(i) that the chief executive intends to cancel the person’s appointment as a duly qualified person (the
"proposed action" ); and(ii) the ground for the proposed action; and(iii) an outline of the facts and circumstances forming the basis for the ground for the proposed action; and(iv) that the person may, within 14 days after the notice is given or a longer period agreed to by the chief executive, give the chief executive a written response to the proposed action; and(b) have regard to any response received under paragraph (a) (iv) .
(2) If the chief executive cancels a person’s appointment as a duly qualified person under this subdivision—(a) the chief executive must give the person an information notice for the decision to cancel the appointment; and(b) the cancellation takes effect from the day the person is given the information notice.
