171 Amendment of s 174 (Proceedings for offences)

(1) Section 174 (1) —
omit, insert—

(1) A person may bring proceedings (
"offence proceedings" ) in a Magistrates Court on a complaint to prosecute another person for an offence against parts 2 to 5 or section 226.

(1A) The person may bring the offence proceedings whether or not any right of the person has been, or may be, infringed by, or because of, the commission of the offence.

(2) Section 174 (2) , ‘a proceeding’—
omit, insert—
offence proceedings

(3) Section 174 (3) —
omit.

(4) Section 174 (1A) and (2) —
renumber as section 174 (2) and (3) .
