PUBLIC SERVICE ACT 2008 No. 38 - SECT 156

156 Application of div 3

(1) This division applies if, under a part 6 directive, the chief executive of a department decides that duties to be performed in the department are likely to involve providing dedicated services or activities if--

(a) a child is the primary or significant client or children are the primary or significant client group; or
(b) the nature of contact with a child or children, and the context in which that contact happens, creates an unacceptable level of risk for the child or children.

(2) Duties to which this division applies are child-related duties.

(3) This division applies despite anything in the Criminal Law (Rehabilitation of Offenders) Act 1986 but does not limit any other law, or other provision of this Act, under which information that is police information may be obtained.
