MEDICINES AND POISONS (PEST MANAGEMENT ACTIVITIES) REGULATION 2021 - REG 57

57 Secure storage

(1) This section applies to a business operator storing a fumigant or pesticide at a place for use for the operator’s pest management business.

(2) The business operator must take all reasonable steps to ensure that the place has the following features—

(a) the place is able to be locked when unattended;

(b) the place has a floor and other surfaces that are impervious to the fumigant or pesticide;

(c) the place is built in a way that any leakage or escape of the fumigant or pesticide is not likely to cause harm or nuisance to a person or the environment;

(d) the place is adequately ventilated;

(e) the place provides the fumigant or pesticide with protection from the weather;

(f) the place is located in an area that is separated from a residence or another work area that is not used for pest management activities.

Penalty—

Maximum penalty—20 penalty units.
