11 Declaration for Acts Interpretation Act 1954, section 20A Section 19, as in force before the commencement, is declared to be a law to which the Acts Interpretation Act 1954, section 20A applies.
12 Continuing entry to, and use of, land under existing development approval(1) This section applies if—(a) immediately before the commencement—(i) a development approval was in effect; and(ii) the development approval authorised development on land outside the former Great Sandy Marine Park; and(b) on the commencement, the land is situated in the new Great Sandy Marine Park.(2) From the commencement, and while the development approval is in effect, a person may continue to enter and use the land, including a structure on the land, for carrying out the development.(3) This section applies despite any provision of the Marine Parks (Great Sandy) Zoning Plan 2024 relating to the entry or use of the land.(4) In this section—
"development" means a development under the Planning Act 2016 or the repealed Sustainable Planning Act 2009 .
"development approval" means a development approval under the Planning Act 2016 or the repealed Sustainable Planning Act 2009 .
"former Great Sandy Marine Park" means the marine park described in schedule 3, as in force immediately before the commencement.
"new Great Sandy Marine Park" means the marine park described in schedule 3.
