List of annotations . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . 13 13 13 14 14 14 15 s1 3 Suppression of Gambling Act 1895 s4 Suppression of Gambling Act 1895 [as amended by all amendments that commenced on or before 21 March 2005] An Act for the suppression of gambling Part 1 1 Short title Preliminary This Act may be cited as the Suppression of Gambling Act 1895. 4 Interpretation In this Act-- gaming Acts means the following Acts-- · · · Charitable and Non-Profit Gaming Act 1999 Criminal Code, sections 232 to 235 Racing Act 2002. instrument of gaming includes lists, sheets, books, tickets, cards, coins, kip, dice, dice-boxes, dominoes, croupiers, and all documents and writings used, or apparently used, or capable of being used in carrying on or in connection with a lottery, betting, or gaming other than betting on horse racing, including the racing of trotting horses; lottery means any scheme or device for the sale, gift, disposal, or distribution of any property depending upon or to be determined by lot or chance, whether by the throwing or casting of any dice or the drawing of any tickets, cards, lots, numbers or figures, or by means of any wheel or trained animal, or otherwise howsoever. s4 4 Suppression of Gambling Act 1895 s4 owner of a house, office, room, or other place, or of any land of whatever tenure, or building, includes every person, company, or corporation who is, whether at law or in equity-- (a) (b) entitled to the same for any estate of freehold in possession; or in actual receipt of or entitled to receive, or if the house, office, room, place, land, or building were let to a tenant would be entitled to receive, the rents and profits of the same, whether in his or her own right or as trustee or agent of another; and, in the case of a house, office, room, place, land, or building subleased, includes any lessee or sublessee from whom a sublessee holds; place, for the purposes of the provisions of this Act relating to gaming and the gaming Acts, means any house, office, room, tent, resort, or other place in or out of an enclosed building, vessel, or premises, whether upon land or water, whether private property or otherwise, and any vehicle, and includes any place declared by the Governor in Council by order in council to be a place for the purposes of this Act. property means any real or personal property whatsoever, whether situate or being within or without the State, or of any right thereto or share or interest therein. public place includes every road and also every place of public resort open to or used by the public as of right, and also includes-- (a) any vessel, vehicle, building, room, licensed premises, field, ground, park, reserve, garden, wharf, pier, jetty, platform, market, passage, or other place for the time being used for a public purpose or open to access by the public, whether on payment or otherwise, or open to access by the public by the express or tacit consent or sufferance of the owner, and whether the same is or is not at all times so open; and a place declared, by regulation, to be a public place; (b) unlawful game, for the purposes of the Gaming Acts and this Act and without limiting the meaning of the term unlawful game, means the games known or called respectively s4 5 Suppression of Gambling Act 1895 s4 `fan-tan', `fan-tan troy', `troy', `pak-a-pu', `fruit machines' of every description, and any mechanical contrivance in the nature of or similar to a fruit machine, `two-up', `heading them', `sin-ki-loo', `tray bit peter', `Yankee grab', and `hazard', and all similar games and machines; and the disposal of money or other property by lottery or chance or by mixed chance and skill; and all games with cards, dice, or other instruments wherefrom any person or persons derives or derive a percentage of the amount wagered or bet. The expression fruit machine and any mechanical contrivance in the nature of or similar to a fruit machine shall not include an automatic machine used solely for the sale, by mechanical means after placing therein the necessary coin, of confectionery, matches, peanuts, or other article or commodity not being an article or commodity the sale of which by an automatic machine is prohibited under any law of the State. The term unlawful game shall not include any game of chance or game of mixed chance and skill in respect of which a permit has been issued by the Attorney-General or other Minister of the Crown for the time being charged with the administration of the Art Union Regulation Act 1930 and under and subject to the provisions of the Art Union Regulation Act 1930.1 Provided always that the provisions of such Act are fully complied with and observed and obeyed accordingly in respect of such game of chance or game of mixed chance and skill; vehicle means any car, tramcar, railway carriage, carriage, drag, wagon, cart, truck, handcart, barrow, bicycle, tricycle, motor cycle, motor car, motor vehicles, and any vehicle of any kind whatsoever. 1 Now see the Acts Interpretation Act 1954, section 14H and the Charitable and Non-Profit Gaming Act 1999. s5 6 Suppression of Gambling Act 1895 s9 Part 2 5 Lotteries Unlawful to establish, commence, be a partner in etc. any lottery It shall be unlawful to establish, commence, or be a partner in, or to manage or conduct, or assist in managing or conducting, any lottery. 6 Unlawful to sell tickets for any lottery It shall be unlawful to sell or dispose of or to endeavour to sell or dispose of any ticket or other means by which permission or authority is gained or given to any person to throw for, compete, or have any interest in any lottery. 7 Unlawful to sell or dispose of etc. any property by lottery It shall be unlawful to sell or dispose of, or endeavour to sell or dispose of, or agree or promise, whether with or without consideration, to sell or dispose of any property by lottery. 8 Sweeps etc. unlawful Every transaction wherein any money or other property is received as or for the consideration for any assurance, undertaking, promise, or agreement, express or implied, to pay, give, or distribute thereafter to or among any person or persons by lottery any money or other property on any event or contingency whatsoever, or as or for the consideration of securing the paying, giving, or distributing by some other person of any money or other property on any event or contingency whatsoever, and every scheme of the nature commonly knows as a `sweep' or `consultation', shall be deemed to be a lottery within the meaning of this Act. 9 Missing-word competition etc. unlawful Every transaction wherein any property is received as or for the consideration for any assurance, undertaking, promise, or agreement, express or implied, to pay, give, or distribute s 10 7 Suppression of Gambling Act 1895 s 14 thereafter any money or other property to or among any person or persons who shall successfully guess or otherwise by chance find out, supply, or fill in a word, letter, figure, or number omitted from any sentence or part of a sentence, paragraph or part of a paragraph whatsoever, or as or for the consideration of securing the giving or distributing by some other person of any money or other property on any such event or contingency as aforesaid, and every scheme of the nature commonly known as a `missing-word' competition, shall be deemed to be a lottery within the meaning of this Act. 10 Unlawful to print or publish ticket for or otherwise advertise unlawful lottery (1) It shall be unlawful to publish or cause to be published by means of radio broadcast or television, or to print, publish, or exhibit, or to cause to be printed, published, or exhibited, any ticket for, or any advertisement, sign, or other notice of or relating to, the drawing or intended drawing of any unlawful lottery, or of or for the sale of any ticket or chance of or in any such lottery, or concerning or in any manner relating to such lotteries in general, or to any such particular lottery or to any ticket, chance, or share thereof or therein. (2) In this section-- unlawful lottery means any lottery which is not declared by any Act to be lawful, and includes any foreign art union within the meaning of the Art Union Regulation Act 1964. 11 Penalty Any person who offends against any of the foregoing provisions of this Act shall be liable, on conviction, to 6 months imprisonment, or to a fine not exceeding $200. 14 What this Act does not apply to Nothing herein contained shall be deemed or construed to repeal, alter, or in any way affect the Totalisator Restriction Act 1889. s 15 8 Suppression of Gambling Act 1895 s 16 Part 3 15 Gaming Provisions relocated from the Vagrants, Gaming and Other Offences Act 1931 (1) To remove any doubt, it is declared that the relocated provisions were not re-enacted by the Summary Offences Act 2005 but merely moved (without re-enactment) from the Vagrants, Gaming and Other Offences Act 1931 to this Act. (2) Without limiting subsection (1) and to further remove any doubt, it is also declared that the relocation to this Act of the relocated provisions did not impliedly repeal or amend, or otherwise affect the operation of the relocated provisions or the provisions of any other law and, in particular, did not affect the meaning or effect that the relocated provisions, or the provisions of the other law, had because of the respective times when they were enacted. (3) In an Act or document, a reference to a relocated provision may, if the context permits, be taken to be a reference to the provision in this Act. (4) In this section-- relocated provisions means the provisions relocated to this Act by the Summary Offences Act 2005, schedule 1, amendment of the Vagrants, Gaming and Other Offences Act 1931. 16 (1) Any person who-- (f) plays or bets at any unlawful game, or plays or bets in any street, road, highway, or other public place at or with any table or instrument of gaming at any game or pretended game; without lawful excuse (the proof of which shall be upon the person) has in the person's custody or possession any instrument of gaming or any instrument which, in the opinion of the court, is constructed or kept or used as a means of gaming or cheating; (g) s 19 9 Suppression of Gambling Act 1895 s 20 shall be liable to a penalty of $100 or to imprisonment for 6 months. (2) Every instrument referred to in subsection (1)(g) shall, by the conviction of the offender, become forfeited to Her Majesty. 19 In addition to and without limiting any other provision of this Act, or any provisions of the Gaming Acts or the Criminal Code, any person who-- Unlawful games (a) plays or bets at any unlawful game; (b) has in the person's possession any fruit machine or any mechanical contrivance in the nature of or similar to a fruit machine; gives or sells any ticket or chance or share in any ticket or chance in any unlawful game; in or near any public place, or within the view or hearing of any person therein, or in or near any licensed premises, or in any vacant place whether fenced or not, plays or bets, or solicits or encourages any other person to play or bet-- (i) at any game or pretended game of chance; or (ii) at or on any game or trick of sleight of hand; or (iii) at or on any game or trick played with any instrument which, in the opinion of the court, is constructed or kept or used as a means of cheating; shall be liable to a penalty of $100 or to imprisonment for 6 months. 20 Cheating at games (c) (d) Any person who, by any fraud, unlawful device, or ill-practice-- (a) in playing at or with cards, dice, tables, or any other game; or s 21A 10 Suppression of Gambling Act 1895 s 22 (b) (c) in bearing a part in the stakes, wages, or in betting on the sides or hands of the players; or in wagering on the event of any game, sport, pastime, or exercise; wins or attempts to win from any person to himself, herself or any other person any money or other property shall be liable to a penalty of not less than $20 or more than $100 or to imprisonment for 6 months. 21A Seizure of fruit machines (1) This section applies if a police officer lawfully seizes a fruit machine or a similar machine. (2) The machine is forfeited to the State. (3) However, such forfeiture shall not prejudice any proceedings against any person alleged to have committed an offence with respect to such fruit machine or other machine. 22 Betting on licensed premises (1) Any licensed victualler within the meaning of the Liquor Act 19122 who permits the licensed victualler's licensed premises to be used for the purpose of betting or wagering on any future event or contingency, by whatever means such betting or wagering is conducted or carried on on such licensed premises, shall be guilty of an offence and liable to a penalty not exceeding $200. (2) Where any licensed premises are used for the purposes of such betting or wagering as aforesaid, the licensee shall for all purposes of this section be deemed to permit the licensee's licensed premises to be used for the purpose of so betting or wagering unless the licensee proves that the licensee had no knowledge and no means of knowing that the licensee's licensed premises were used for the purposes of betting or wagering. 2 Now see the Acts Interpretation Act 1954, section 14H and the Liquor Act 1992. s 22A 11 Suppression of Gambling Act 1895 s 34 22A Application of s 22 Section 22 does not apply to betting on a totalisator operated at licensed premises by or on behalf of the Totalisator Administration Board under the Racing and Betting Act 1980.
