After section 14 insert:
14A—Disapplication of State occupational health and safety laws
(1) The prescribed
occupational health and safety laws do not apply in relation to—
(a) a
facility; or
(b) a
person at a facility; or
(c) a
person near a facility, to the extent to which the person is affected
by—
(i)
a facility; or
(ii)
activities that take place at a facility; or
(d)
activities that take place at a facility.
(2) A reference in
subsection (1) to the prescribed occupational health and safety laws is a
reference to such of the provisions of those laws that, but for subsection
(1), would apply in the adjacent area by virtue of the
Off-shore Waters (Application of Laws) Act 1976 or the cooperative scheme
within the meaning of the Crimes at Sea Act 1998 .
(3) In this
section—
"facility" has the same meaning as in Schedule 7;
"prescribed occupational heath and safety laws" mean any laws of the State
relating to occupational health and safety (whether or not they also relate to
other matters) that are prescribed by the regulations for the purposes of this
section.
(4) This section
applies despite anything to the contrary in the
Off-shore Waters (Application of Laws) Act 1976 or the Crimes at Sea
Act 1998 .
