CLAUSE NOTES Living Marine Resources Management Amendment Bill 2017 Clause 1 Short title and citation. Clause 2 The Act commences on the day on which it receives Royal Assent. Clause 3 The Principal Act is the Living Marine Resources Management Act 1995. Clause 4 Section 40 amended (Miscellaneous matters) Subsection 2 is amending by omitting “Minister, by Public Notice,” and substituting “Minister” to provide for other means for determinations to be made. Subsection 3 is inserted to provide that the means for making determinations provided for by subsection 2 must be specified in rules. Clause 5 Section 255A inserted After section 255, section 255A is inserted. Subsection 1 provides definitions of “board trawl net” and “pair trawl net” and provides that a “trawl net” means a board trawl net or a pair trawl net. Subsection 2 provides that a person must not possess a trawl net on a fishing vessel in State waters unless that possession is authorised under the law of another jurisdiction. Subsection 3 provides that a person must not use a trawl net in State waters. Clause 6 Section 279 amended (Industry levy) Subsection 2A is inserted that provides that a levy set under subsection 2 of section 279 may be expressed in fee units as it were a fee under the Fee Units Act 1997 to allow for the levy to increase commentate to changes in the fee unit linked to CPI. Clause 7 Repeal of Act Provides that the Living Marine Resources Management Amendment Bill 2017 is repealed three hundred and sixty five days from the day it commences. Page 1 of 1
