MENTAL HEALTH AMENDMENT BILL 71 OF 2009

                  CLAUSE NOTES
           Mental Health Amendment Bill 2009



Clause 1   Short Title

Clause 2   Commencement
           Provides for the Act to commence on Royal Assent.

Clause 3   Principal Act
           Names the Mental Health Amendment Act 2005 as the legislation
           that the Bill amends.

Clause 4   Section 19 amended (Expiry)
           Amends section 19 of the Mental Health Amendment Act 2005.
           Section 19 is a sunset clause which provides that the
           amendments made to the Mental Health Act 1996 by the Mental
           Health Amendment Act 2005 relating to community treatment
           orders expire four years and six months after the
           commencement of the Mental Health Amendment Act 2005, that
           is, on 11 January 2010.
           This clause amends section 19(1) to provide that the
           amendments made by the Mental Health Amendment Act 2005
           will expire six years and six months after the commencement of
           that Act, that is, on 11 January 2012.

Clause 5   Repeal of Act
           Provides for the Act's repeal 90 days after its commencement
           (by which time the amendments achieved by the Act will be
           incorporated to the Mental Health Amendment Act 2005).
