SECURITY AND INVESTIGATIONS AGENTS AMENDMENT BILL 2018 BILL 51 OF 2018

                                    CLAUSE NOTES

              Security and Investigations Agents Amendment Bill 2018

Part 1- Preliminary

Clause: 1      Short title
               This clause provides that, once passed, the Bill will be cited as the Security and
               Investigations Agents Amendment Act 2018.

Clause 2:      Commencement
               Provisions of this Bill are to commence on Royal Assent.

Clause 3:      Principal Act
               Any reference to “the Principal Act” refers to the Security and Investigations
               Agents Act 2002.

Clause 4:      Section 41 amended (Exemptions)
               Under the Principal Act, a person must hold a licence authorising the
               undertaking of security activities, including conducting bag checks.
               This clause allows an exemption from holding such a licence for staff employed
               in a retail business, provided their activities are limited to conducting a bag
               check, as part of their employment, of items in the possession of a person
               leaving the retail property.
               A bag is defined as including a bag, parcel, carton, container or another item
               that could reasonably be expected to conceal goods.
               The retail business must display a prominent sign at each entrance to the
               property advising that allowing a bag check is a condition of entry.
               The bag check must also be carried out in accordance with a Code of
               Conduct issued by the Director of Consumer Affairs and Fair Trading.

Clause 5:      Repeal of Act
               The amendment Act is set to be repealed one year after enactment.
