FACT SHEET Glenorchy City Council (Dismissal of Councillors) Bill 2017 The Glenorchy City Council (Dismissal of Councillors) Bill 2017 provides for the dismissal of the Glenorchy City councillors, and for the holding of an early council election. Specifically, the Bill provides that: Glenorchy City councillors are dismissed on the day the Act takes effect; the closing date for the Glenorchy City Council election is set for 16 January 2018; all Ministerial powers in the Local Government Act 1993 with respect to the Glenorchy City Council are preserved, with the exception of those that are altered by the application of the Bill; following dismissal, and prior to the election and appointment of the councillors, a commissioner may be appointed to act in the interests of the community and to provide stability and good governance to the Council; and the Board of Inquiry into the Glenorchy City Council is unaffected by the Bill. The Bill is a stand-alone piece of special-purpose legislation, and does not operate to amend any other law, including the Local Government Act 1993. The Bill has an expiry date of 1 December 2018. The Bill does not seek to subvert, or interfere with, the Board of Inquiry process or any pending legal proceedings in relation to that process. It simply allows for the dismissal of Glenorchy City councillors – and for the subsequent calling of a council election before October 2018 - irrespective of any ongoing or new legal challenges to the Board of Inquiry. The Bill specifically provides for the completion of the Board’s work, including the delivery of its report of findings and recommendations, as and when appropriate, in accordance with the provisions of the Local Government Act 1993.
