LIMITATION AMENDMENT BILL 2013 BILL 44 OF 2013

    Limitation Amendment Bill 2013

The Bill amends the Limitation Act 1974 to:

    Abolish the requirement to seek leave of the court to
    take action in a personal injury matter where the period
    of 12 years has expired since the act or omission which
    gave rise to the claim and make any necessary
    consequential amendments; and

    Provide for an application to a Court to extend the
    limitation period for personal injury for a further 3 years
    i.e. for up to 6 years from the date of discoverability;
    and

    Clarify when an extension of time will be available by
    reason of disability

    Provide that a person who might be out of time under a
    previously applicable provision may apply to a court to
    extend the limitation period to three years from the
    amendment day, defined as the day on which the
    amendments in this Bill commence.
