FACT SHEET Occupational Licensing National Law Repeal Bill 2016 This Bill is designed to repeal the Occupational Licensing National Law Act 2011. This legislation was drafted in response to a COAG agreement in 2009 to establish licenses with uniform criteria for specified occupations to reduce the cost and regulatory complexity of operating across multiple jurisdictions with different licensing requirements. To facilitate the implementation of the Agreement, the Occupational Licensing National Law Act 2011 was established in Victoria. This national Act established the National Occupational Licensing Authority (NOLA) as the body responsible for the administration of the national licensing system. This Act was passed by the Tasmanian Parliament with some parts proclaimed in December 2011, thus making some parts of the national Act the law in Tasmania. However, following concern from some states about the national licensing scheme and its costs, in December 2013, COAG decided to disestablish NOLA and agreed that each jurisdiction would repeal their legislation that applies to the national Act. On this basis, it is necessary for Tasmania to repeal the Act. Although some sections of the Act have been proclaimed and commenced in 2011, the administrative processes to implement did not occur. This means that repealing the Act is very straightforward as there are no processes or administrative bodies to unravel. Page 1 of 1
