REPEAL OF REGULATIONS POSTPONEMENT BILL (NO. 2) BILL 63 OF 2011

                        FACT SHEET

 Repeal of Regulations Postponement Bill (No. 2) 2011



· This Bill is one of a package of Bills developed to give effect
  to the national model work health and safety laws in
  Tasmania.

· The Work Health and Safety Bill 2011 and the Work Health
  and Safety (Transitional and Consequential Provisions Bill) 2011
  together repeal and replace the existing Workplace Health
  and Safety Act 1995 with a proposed Act mirroring the
  provisions of the national Model Work Health and Safety
  Bill.

· The commencement of the above Bills is dependent on
  proposed regulations, based on the national Model Work
  Health and Safety Regulations, commencing on the same day.

· The intended commencement date is 1 January 2012.
  However, given that the model regulations have been
  developed through national processes, and have already
  suffered some delays, there is a potential for further delays
  to occur.

· Tasmania's staged repeal of the Workplace Health and Safety
  Regulations 1998 is due to be effected on 1 January 2012.

· To prevent any time gap arising between the repeal of       the
  existing Workplace Health and Safety Regulations and        the
  coming into effect of the replacement regulations, if       the
  latter are delayed, the Bill postpones the repeal date of   the
  former until 1 January 2013.
