FACT SHEET Repeal of Regulations Postponement Bill 2010 The Subordinate Legislation Act provides for the systematic repeal of subordinate legislation over a rolling 10-year period. If regulations are to continue to have effect they must be remade in accordance with the requirements of the Act, or have their expiration postponed. The Passenger Transport Regulations 2000 and Passenger Transport (Review of Decisions) Regulations 2000 were previously extended in 2009 by the passage of the Repeal of Regulations Postponement Act 2009. This Act extended the expiry of these Regulations to 1 January 2011. However, the Review of the Passenger Transport Act 1997, the Act under which these regulations are made, has taken longer than expected to complete. As a result of the delay, it has become apparent that it will not be possible to introduce a new Act in 2010. Accordingly, and given that a further extensive round of consultation with industry stakeholders has just commenced, it will not be possible for the necessary regulations for the administration of the new Act to be finalised and Gazetted until towards the end of 2011 or early 2012. This Bill will postpone the automatic repeal of the Passenger Transport Regulations 2000 and the Passenger Transport (Review of Decisions) Regulations 2000 until 1 July 2012.
