STATE SERVICE AMENDMENT (REDEPLOYMENT). BILL 34 OF 2011

            State Service Amendment
             (Redeployment) Bill 2011
The purpose of the proposed Bill is to amend Section 47(10) of the State
Service Act 2000 by changing the period of time within which an employee is
subject to redeployment by the State Service Commissioner from 12 months
to 6 months.

An employee becomes subject to redeployment after the Commissioner has
accepted a recommendation by a Head of Agency, after due process, that
an employee be made available for redeployment.

If the employee is unable to be redeployed within the 6 month timeframe the
Commissioner is to notify the Head of Agency who may then request the
Minister (administering the State Service Act) to terminate the employee
under Section 44 (3)(b) of the Act.

This Bill does not alter any other aspect of Section 47, that is, all other
processes, timeframes, rights and entitlements remain intact. This includes
salary maintenance for 12 months for any employee who is assigned duties of
a lower classification.
