FACT SHEET Taxi and Luxury Hire Car Industries Bill Amendment 2009 The purpose of the Taxi and Luxury Hire Car Industries Amendment Bill 2009 is to rectify some minor technical deficiencies identified in the Taxi and Luxury Hire Car Industries Act 2008 (the Act) since it commenced late last year and to provide for the review of administrative decisions under the Act. In summary, the purpose of the amendments is to: � make it clear that in issuing licences under the Act, the Commission may impose conditions on licences without having to provide the person applying for the licence with the opportunity to make representations regarding the proposed conditions. The right to make representations in regard to the imposition of conditions, a variation of conditions or the revocation of conditions will be confined to existing licences; � provide that an applicant for an owner operator licence must be the registered operator of a vehicle suitable to be used as a taxi prior to the issue of a licence. The requirements for a vehicle suitable for use as a taxi will be prescribed in the Taxi Industry Regulations 2008. They will include requirements that the vehicle meets the relevant standards, is within the age limits for taxis and that the vehicle has all of the relevant taxi equipment (such as meters and roof signs), fitted to it; and � provide a regulating power for the review of administrative decisions made under the Act and the regulations.
