DISABILITY SERVICES ACT 2011 - SECT 44

Provisions in respect of approvals by Tribunal
(1)  An approval under section 42 may be granted subject to the conditions or limitations specified in the approval.
(2)  Without limiting the generality of subsection (1) , an approval under section 42 may be granted on the condition that reports, in relation to the carrying out of restrictive interventions of the type authorised under the approval, are given to the Tribunal, at the times, or in the circumstances, specified in the condition, by the disability services provider or funded private person who made the application for the approval.
(3)  An approval under section 42 expires 90 days after it is granted, unless it is granted at the conclusion of a hearing in accordance with section 42(5) , in which case it expires after 6 months or such other period, not exceeding 2 years, as agreed to by the Senior Practitioner and specified in the approval.
(4)  Nothing in this Act is to be taken to prevent the granting of more than one approval under section 42 in relation to the same person with disability.
