A person must not use a Type B appliance –

(a) unless the gas installation of which the appliance forms a part has been –

(i) accepted by the Director of Gas Safety in accordance with this Division; or

(ii) installed in accordance with an accepted safety case; or

(b) otherwise than in prescribed circumstances.

Penalty:  In the case of –

(a) a body corporate, a fine not exceeding 200 penalty units; or

(b) a natural person, a fine not exceeding 50 penalty units.
