(1) On the first attendance before the Court of a defendant charged with a summary offence, the Court (a) must cause the charge to be read to the defendant, or explain to the defendant, in simple terms, the offence with which he or she is charged; and(b) if the defendant is not represented by a legal practitioner, must explain to the defendant, in the manner specified by the rules of court, the defendant's rights and duties under this Act in respect of the charge; and(c) must invite the defendant to enter a plea to the charge.(2) The Court is not required to comply with subsection (1)(a) if satisfied that the defendant (a) is represented by a legal practitioner; or(b) has received a copy of, and understands the nature of, the charge.
