SENTENCING ACT 1997 (NO. 59 OF 1997) - SECT 95
Appeal against sentence imposed on variation or breach
A person who is sentenced by a court in proceedings for variation or breach of
a sentencing order has a right of appeal against that sentence as
if (a) the court had, immediately before imposing that sentence,
found the person guilty, or convicted the person, of the offence in respect of
which the sentencing order was originally made; and
(b) the sentence were a
sentence imposed on that finding of guilt or conviction.
