Regulation 157 of the Principal Regulations is amended as follows:(a) by omitting "Australian Transport Council" from the definition of emergency plan in subregulation (1) and substituting "Standing Council on Transport and Infrastructure" ;(b) by inserting the following subregulation after subregulation (2) :(2A) On becoming aware of a dangerous situation involving a placard load, the prime contractor or rail operator transporting the load must do everything that the emergency plan for the transport of the load requires the prime contractor or rail operator to do that is relevant to the situation.Penalty: In the case of (a) a body corporate, a fine not exceeding 170 penalty units; or(b) an individual, a fine not exceeding 35 penalty units.(c) by inserting the following subregulation after subregulation (3) :(3A) On becoming aware of a dangerous situation involving a placard load, the consignor of the load must do everything that the emergency plan for the transport of the load requires the consignor to do that is relevant to the situation.Penalty: In the case of (a) a body corporate, a fine not exceeding 170 penalty units; or(b) an individual, a fine not exceeding 35 penalty units.
