ELECTRICITY SUPPLY INDUSTRY (CONTESTABLE CUSTOMER) REGULATIONS 2005 (S.R. 2005, NO. 88) - REG 17
Fallback contract not to prevent prosecution
The existence of a fallback contract does not prevent legal proceedings being
taken against the customer with the fallback contract, if the customer's
actions constitute an offence – (a) under section 111(1) of the
Act; or
(b) of stealing under Chapter XXIV of the Criminal Code .
