ELECTRONIC TRANSACTIONS REGULATIONS 2011 (S.R. 2011, NO. 40) - REG 5

Division 2 of Part 2 of Act not to apply to certain requirements and permissions
Division 2 of Part 2 of the Act does not apply to –
(a) a requirement or permission relating to the execution or revocation of a will, codicil or other testamentary instrument; or
(b) a requirement or permission relating to enduring guardians or powers of attorney; or
(c) a requirement that information or a document be delivered only by personal service.

These regulations are administered in the Department of Justice.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations –
(a) provide that section 5(1) of the Electronic Transactions Act 2000 does not apply to certain transactions; and
(b) provide that Division 2 of Part 2 of that Act does not apply to certain requirements and permissions; and
(c) are made consequentially on the repeal of the Electronic Transactions Regulations 2001 under section 11 of the Subordinate Legislation Act 1992 .
