Summary Offences Amendment (Begging or Gathering Alms) Bill 2016 Introduction Print EXPLANATORY MEMORANDUM Clause Notes Clause 1 states the purpose of the Bill. The purpose of the Bill is to amend the Summary Offences Act 1966 to repeal the offence of begging or gathering alms and for other purposes. Clause 2 is the commencement provision. It provides that the Bill comes into operation on the day after the day on which it receives Royal Assent. Clause 3 states that the current sections 49A(1) and 49A(2) of the Summary Offences Act 1966 are repealed and replaced by a new section 49A which retains only the current section 49A(2) relating to causing, procuring, or encouraging a child to beg or gather alms. Consequently, the current title of section 49A, Begging or Gathering Alms, is no longer appropriate. The new section 49A by retaining the provisions in the current section 49A(2) is replaced with the more appropriate title: Offence to Cause, Procure or Encourage Child to Beg or Gather Alms. The maximum penalty of 12 months imprisonment remains. Clause 4 provides for the automatic repeal of the Bill on the first anniversary of its commencement. 581PM17 1 BILL LC INTRODUCTION 5/12/2016
