An Act to.regulate the Temporal Affairs ofthe Synod of Victoria and to amend the Law relating thereto. [Assented to 8tli April, 1854.J ? T HEREAS by an Act of the Governor and Leoislative Council of Preamble. the Colony of New South Wales passed in the eighth year of the reign of 8Wm, iv\, No. 7. His late Majesty King William the Fourth intituled " An Act to regulate " the temporal affairs of Presbyterian Churches and Chapels connected "with the Church of Scotland in the Colony of Neiv South Wales" and 4 Vic, No. 18. of another Act of the said Governor and Legislative Council passed in the fourth year of the reign of Her present Majesty Queen Victoria intituled " An Act to amend an Act intituled ' An Act to regulate the temporal " ' affairs of the Presbyterian Churches and Chapels connected with the Church of Scotland in the Colony of New South Wales'" certain powers privileges and advantages were conferred on the Synod of Australia in connexion with the Established Church of Scotland and the Ministers of the congregations subject to the spiritual jurisdiction thereof And whereas the Ministers and congregations subject to the spiritual authority of the Synod of Australia situated within that part of the territory of New South Wales known as the District of Port Phillip and which has since been erected into the separate Colony of Victoria were constituted and have since constituted a subordinate Presbytery of the said Synod bearing the designation of the Presbytery of Melbourne And whereas it is expedient that the Presbyterian Church in the Colony of Victoria should be withdrawn from the jurisdiction of the said Synod of Australia and be formed into a distinct Synod separate from and unconnected with any other Church or Ecclesiastical body whatsoever possessing full and independent powers of self-government and bearing the name of " The Synod of Victoria" And whereas it is also expedient that the said recited Acts be so amended that they may apply to the said Synod of Victoria having the above powers 13c" it enacted therefore by His Excellency the Lieutenant Governor of the s;id Colony of Victoria by ami with the advice and. consent of the Le<>'i;! iiire Couueil (.hereof a.-; lullows :--· _J.I._The Fublishcd as- /,!i:tuc.if- io 7a ' Ykiot'i^ Gvvcnunent Cuzvtte,' of Thursday, im April, im.--Xo. yu. 1854.] 17 VICTORIA. Po^m and privileges conferred Snformi *· The several powersjn-ivilegcs and advantages conferred u]>on iho. upon Synod of Australia in connexion Avith the Established Church of Scotland uI)I.n and lIl c Ministers of the Contritions under its spiritual superintendence AuS Synod of Victoria. ])y tlic said recited Acts shall as soon a.s the said Svnod of Victoria shall have been formed and notice of such formation shall have been published in the Victoria Government Gazette be vested in and belong to \hr. said Synod of Victoria and the Ministers of the Congregations under its spiritual superintendence as fully and effectually to all intents and purposes as if the said Synod of Victoria had been formed and in existence at the time of the passing of the said recited Acts and been specially named and mentioned therein Provided always that the several poAvers privileges and advantages conferred by this Act upon the said Synod of Victoria shall cease and determine unless the said Synod shall continue its adherence to the Doctrines Form of Worship Discipline and Government laid down Real estate vested in in The Confession of Faith The Directory for Public Worship the Form of Presbyterial Church Government and the Larger and Shorter Catechisms agreed on by the Assembly of Divines at Westminster in the year One thousand six hundred and forty three and approved by t\\^ Church of Scotland, and in the Second Book of Discipline of that Church. II. All and every the real estate in all Churches Chapels and Synod of AustraiS" Ministers' Dwellings and the sites of the same and in all Burial Grounds and &c, to be held by Glebe Lands and in all other lands and hereditaments appertaining imdev^Synod Tf thereunto situate respectively in the said Colony of Victoria Avhich Victoria, &c. have heretofore been held or are UOAV held by Trustees appointed under the provisions of the said recited Acts or either of them in behalf of the several Congregations under the spiritual superintendence of the said Synod of Australia or by the Trustees of any Church or Churches in which it is required that Divine Service shall be performed by an Ordained Minister of the Church of Scotland shall continue to be held by the same Trustees and their successors duly and lawfully appointed according to the provisions of the said Acts or one of them in behalf of the same Congregations under the spiritual and ecclesiastical superintendence of the Synod of Victoria as fully and effectually in all respects as if the said Synod were specially named in the said recited Acts and invested with all the powers privileges and advantages thereby or by either of them conferred on the said Synod of Australia.
