Victorian Numbered Acts Victorian Numbered Acts(1) An infringement offender serving an order of imprisonment under section 165(3) who makes an application under section 167 may apply to the Magistrates' Court to be granted bail in accordance with the Bail Act 1977 .
(2) On an application for bail under subsection (1), the Magistrates' Court may grant the infringement offender bail pending the rehearing of the matter.
