MAJOR EVENTS LEGISLATION AMENDMENT (UNAUTHORISED TICKET PACKAGES AND OTHER MATTERS) ACT 2022 (NO. 5 OF 2022) - SECT 5

New sections 160A, 160B and 160C inserted

After section 160 of the Principal Act insert

        " 160A     Register of authorised ticket package sellers

    (1)     For each sports ticketing event, the sports event organiser of the sports ticketing event must keep a register of authorised ticket package sellers.

    (2)     The register must include—

        (a)     the full name or business name (as the case requires) of each authorised ticket package seller; and

        (b)         the ABN or ACN (as the case requires) of each authorised ticket package seller; and

        (c)     the Internet site of each authorised ticket package seller where ticket packages are authorised to be sold; and

        (d)     if a person included on the register ceases to be an authorised ticket package seller, the date the authorisation ceased.

    (3)     The sports event organiser must take reasonable steps to ensure that the information included on the register is accurate.

    (4)     Without limiting subsection (3), the sports event organiser must update the register as soon as practicable if—

        (a)     the sports event organiser becomes aware that the information included on the register is not accurate; or

        (b)     a person included on the register ceases to be an authorised ticket package seller; or

        (c)     a person who is not included on the register becomes an authorised ticket package seller.

    (5)     Subject to subsection (6), the sports event organiser must publish the register on the official Internet site of the sports ticketing event—

        (a)     before any tickets (whether or not in a ticket package) to the sports ticketing event are advertised or offered for sale; and

        (b)     until after the completion of the sports ticketing event.

    (6)     If there are no authorised ticket package sellers in relation to a sports ticketing event, the sports event organiser must publish a statement to that effect on the official Internet site of the sports ticketing event before any tickets to the sports ticketing event are advertised or offered for sale.

    (7)     For the purposes of subsections (5) and (6), the official Internet site of the sports ticketing event is—

        (a)     an Internet site owned and maintained by the sports event organiser that is the main source of information for the public in relation to the sports ticketing event; or

        (b)     if there is no Internet site referred to in paragraph (a), the main Internet site of the sports event organiser.

        160B     Copy of register of authorised ticket package sellers to be provided to Minister

The sports event organiser must provide a copy of the register of authorised ticket package sellers for a sports ticketing event to the Minister as soon as practicable after the completion of the sports ticketing event.

        160C     Information to be included in advertising of tickets as part of a ticket package

An authorised ticket package seller must include the following information in any advertisement or offer for sale of tickets for the sports ticketing event in a ticket package—

        (a)     the authorised ticket package seller's full name or business name (as the case requires);

        (b)     the authorised ticket package seller's ABN or ACN (as the case requires);

        (c)     a statement that the authorised ticket package seller is authorised by the sports event organiser to sell or distribute tickets to the sports ticketing event in a ticket package.".
