MINERAL RESOURCES (SUSTAINABLE DEVELOPMENT) AMENDMENT ACT 2023 (NO. 23 OF 2023) - SECT 58

    (1)     For the penalty at the foot of section 8AB(1) of the Principal Act substitute —

"Penalty:     In the case of a corporation, 10 000 penalty units;

    In any other case, 2000 penalty units.

Default Penalty:

    In the case of a corporation, 1200 penalty units;

    In any other case, 240 penalty units.".

    (2)     After section 8AB(1) of the Principal Act insert —

    "(1A)     An offence under subsection (1) is an indictable offence.

Note

This offence may be heard and determined summarily (see section 28 of the Criminal Procedure Act 2009 ).".

    (3)     In section 8AB(2) of the Principal Act—

        (a)     in paragraph (a), for "authority; and" substitute "authority.";

        (b)     paragraph (b) is repealed .
