SPECIAL INVESTIGATOR ACT 2021 (NO. 50 OF 2021) - SECT 128

    (1)     In section 3(1) of the Independent Broad-based Anti-corruption Commission Act 2011 insert the following definitions—

"" human source" has the same meaning as in the Special Investigator Act 2021 ;

"Office of the Special Investigator" has the same meaning as in the Special Investigator Act 2021 ;

Royal Commission into the Management of Police Informants has the same meaning as in the Special Investigator Act 2021 ;

"Royal Commission record" means—

        (a)     any answer, information, document or other thing given or produced to the Royal Commission into the Management of Police Informants; and

        (b)     any document or other thing produced by the Royal Commission into the Management of Police Informants; and

        (c)     any copy of an answer, document or other thing given or produced in accordance with paragraph (a) or (b).".

    (2)     In section 3(1) of the Independent Broad-based Anti-corruption Commission Act 2011 , after paragraph (c) in the definition of law enforcement agency insert —

    "(ca)     the Office of the Special Investigator;".

    (3)     After section 3(4) of the Independent Broad-based Anti-corruption Commission Act 2011 insert —

    "(5)     In this Act, a reference to Nicola Maree Gobbo is a reference to the individual named Nicola Maree Gobbo identified as the party EF in the proceeding known as AB (a pseudonym) v CD (a pseudonym); EF (a pseudonym) v CD (a pseudonym) [2018] HCA 58.".
