LOCAL GOVERNMENT (ELECTORAL) REGULATIONS 2005 (SR NO 98 OF 2005) - REG 84

Voter not to receive postal vote

r. 84

    (1)     This regulation applies if the returning officer receives notice that an enrolled voter has died or is no longer entitled to be enrolled as a voter by virtue of section 48(2)(d) of the Constitution Act 1975 .

    (2)     If the returning officer receives a notice under sub-regulation (1) before a postal ballot envelope is posted or delivered to the voter, the returning officer must take all reasonable steps to ensure that a postal ballot envelope is not posted or delivered to the voter.

    (3)     If the returning officer receives notice under sub-regulation (1) and a postal ballot envelope has been sent to the voter, the returning officer must ensure that any returned declaration envelope bearing the voter's name is disallowed.
