Exemption from consultation requirement for discontinuance of certain roads

5. Exemption from consultation requirement for discontinuance of certain roads

A proposed discontinuance of a road or part of a road is exempt for the
purposes of section 12(11)(a) of the Act-

   (a)  if-

   (i)  the road is not a public road; and

   (ii) the road-

                (A)  has never been a public road; or

                (B)  has not been a public road for a period of 3 years; and

   (iii) no existing access to any land will be denied; or

   (b)  if the road is an unused road within the meaning of the Land Act 1958;
        or

   (c)  if it is proposed to discontinue part of the road and-

   (i)  no existing access to any land will be denied; and

   (ii) there is no non-road infrastructure, of which the coordinating road
        authority is aware, installed in, on, under or over the road or the
        part of the road to be discontinued.
