(1) An officer or
employee or former officer or employee of a co-operative or a member of a
committee referred to in section 204(1) must not make improper use of
information acquired by reason of his or her position as an officer or
employee or member to gain, directly or indirectly, an advantage for himself
or herself or for any other person or to cause detriment to the co-operative.
(2) An officer or
employee of a co-operative or a member of a committee referred to in
section 204(1) must not make improper use of his or her position as an
officer or employee or member, to gain, directly or indirectly, an advantage
for himself or herself or for any other person or to cause detriment to the
co-operative.
(a) for
a contravention committed with intent to deceive or defraud the co-operative,
members or creditors of the co-operative or creditors of another person or for
another fraudulent purpose, a fine of $24 000 and imprisonment for
2 years;
(b) in
any other case, a penalty not exceeding a fine of $6 000.
