In this
Division —
affairs of a co-operative includes —
(a) the
promotion, formation, membership, control, transactions, dealings, business
and property of the co-operative; and
(b)
loans made to the co-operative; and
(c)
matters that are concerned with identifying people who are, or have been,
financially interested in the success or failure, or apparent success or
failure, of the co-operative or who are, or have been, able to control or
influence materially the policies of the co-operative; and
(d) the
circumstances in which a person placed, withdrew or disposed of funds with, or
loans to, the co-operative;
costs of an inquiry under this Division
include —
(a) the
expenses of, and incidental to, the inquiry; and
(b) the
expenses payable by the Registrar in proceedings instituted by the Registrar
under this Division in the name of the co-operative the subject of the
inquiry; and
(c) the
part of the remuneration of an officer or employee of the State as the
Minister decides is attributable to matters connected with the inquiry;
investigator means a person appointed under
section 427;
involved person , in relation to an inquiry into
the affairs of a co-operative, means —
(a) an
officer of the co-operative; or
(b) a
person who acts, or has at any time acted, as financial institution, legal
practitioner, auditor or actuary, or in another capacity, for the
co-operative; or
(c) a
person who has, or at any time had, in his or her possession any property of
the co-operative; or
(d) a
person who is indebted to the co-operative; or
(e) a
person who is capable of giving information relating to the affairs of the
co-operative; or
(f) a
person whom an investigator believes on reasonable grounds to be a person
referred to in paragraphs (a) to (e).
